Hi all.

I am under J1 visa, and my program was funded my US government agent. Therefore, I have a 212e (two years rule).

What is the best way to waive this?

I am thinking two possibilities.

a) No objection from my country

2) Request by a us agent.

My question is, that this program waw 100% funded by US, and my country has nothing to do with it, does the no objection has chance? Should I try this, or go for the Request by US agentcy?

It depends on what is your current situation.

Request by a US agency:

If you are working on a project for or of interest to a U.S. federal government agency, and that agency has determined that your departure for two years to fulfill the two-year home-country physical presence requirement would be detrimental to its interest, that agency may request an Interested Government Agency Waiver on your behalf. The Interested Government Agency request must be signed by the head of the agency or his or her designee and submitted directly to the Waiver Review Division.

==> So if you are working for the US agency, then they could request waiver for you.

Thanks for your reply. What is my concern is "must be signed by the head of the agency".

Who is consider as head? Head of department, or head of the whole agency?

Also, I have about 15 published papers, and numerous presentation in conferences. Could I be considered for an o-1 visa?
