Hi all,

Few questions about the K-1 visa process from Stuart (the beneficiary, from UK):

1. As part of the visa process, do they check up on my entire medical history and would mental health issues pose any problems?

2. Does it matter if i am unemployed? Recently became unemployed and wondered if it would be an issue with USCIS? Should we tell them about

this change ASAP?

3. I've also changed my UK address, how soon should they be notified about this?

4. Finally, if there is anyone here already in the USA awaiting their EAD or AOS, what has anyone done for work/income before getting their EAD?

Hi Stuart,

1. As long as you aren't deemed a danger to yourself or society, mental illness is usually not a problem. You will complete a medical exam after the NOA2 and before the interview, which will handle any medical concerns you have.

2. No. Only the petitioner's/co-sponsor's matters.

3. You're going to want to find a way to do this ASAP (I'm not sure if the USC petitioner can submit this change for you, hopefully someone here can tell you?) so that the forms you need once the embassy in London processes the petition can reach you.

4. You legally cannot work a US job until you receive your work permit. The ToS here on VJ do not allow for anyone to advise about how to do anything "illegally". If you have a virtual job based in the UK or are telecommuting to the UK, you are not employed in the US, and that has been done before.

12/31/2012 - Alien Number changed (NOA1 hardcopy in post, but was away for 2 weeks prior)

You'll have a medical exam at Knightsbridge as part of the visa application process. There are mental health-related questions on the questionnaire: http://photos.state.gov/libraries/unitedkingdom/164203/cons-visa/iv018a_medical.pdf

If there is a history, you should visit your GP to see if they can provide you with a letter stating you're no longer a danger to yourself/others.

Once the visa reaches the embassy, it falls with the Dept. of State. It doesn't matter if the visa applicant is unemployed.

3. I've also changed my UK address, how soon should they be notified about this?

Do you still have access to your mail at the former address? The two things they mail to the visa applicant are the P3 letter (stating they've received the approved petition, here's a link to the DS forms, etc.) and the interview letter. Once the petition reaches the embassy, call the Operator-Assistance line and ask for a code so you can email the embassy directly with your change of address information.

4. Finally, if there is anyone here already in the USA awaiting their EAD or AOS, what has anyone done for work/income before getting their EAD?

You cannot legally work in the U.S. for a U.S.-based place of employment without the Employment Authorization Document or a green card.

1. They ask you to report it. They can't get your records without your consent and most people have a hard time in the UK getting actual copies of their own records. Here's the guidelines for mental health the doctor doing your medical exam will go by.

2. No. If they ask at your interview about your job, you can tell them, but your employment doesn't affect the visa. The interview is more like a chat and they might say "what do you do for a living?" "what does your fiancé do?"

3. Your instructions for visa application will be mailed to the address on the petition. The letter isn't that super important because you can get the same information elsewhere, as well as finding out when London has your file and you can proceed. But now would be a good time to call USCIS and give an address change.

4. You can't work without EAD or a greencard...legally that is. If you wanted to work immediately upon arrival, a spouse visa would have been the better choice.

Ive just had my medical at Knightsbridge yesterday heres what happened for me

Its good to read over the offical Knightsbridge page but the questions they ask about mental health can also leave you with alot of question too so thought you may like to read my personal experience(Im not saying its always like this for everyone,but would like to hopefully relieve some fears for you)....look for lynndy38

Im also unemployed,its what the petitioner does that matters.
