Hi,

I can't find an answer to this anywhere! We own some property here in Greece and have an investment account, When I file the AOS can this be used in place of income? We have no American income and can't report much (Greek wages ya know). Most of the property is in my wife's name.

Your investment account would best be moved to a US account. It really doesn't matter how much anybody makes in Greece because only income that will continue from the same source after immigrating would actually be counted towards qualification. To count equity in any property, you must document both the value and any mortgage or other associated debt. Unless the investment account alone is at least three times the income requirement, you're better off with a joint sponsor, if possible. Another option is for the US Citizen to come back and get a job.

Thanks for your reply, that is what I'll end up doing any way. Besides that she has a few pieces of property in her name, can those be used? They have no liens or mmortgage. My brother and sister make enough to cover my wife each, but i'd rather nott burden someone else if I don't have to! I am opening a business upon my return and I guess they'll see that as alittle sketchy without 3 years of returns.

They will not count any "income" from a business until it appears on a current tax return, so YOU will not have "income" until you file the 2013 tax return in 2014. Joint sponsor it is, I'm afraid. You could TRY to qualify on documented equity in real property located in Greece. The worst they can do is say no. Then you get a joint sponsor anyway. If you use real property on the I-864, you must document either the mortgage or document there IS no mortgage, AND get a recent appraisal of the value.
