Hello, My wife got here through a fiancee visa. We got married last December 26. Now I am about to apply for adjustment of status for her. In the application for adjustment of status, can she use my last name now? Or she should still use her maiden name?

She is to use her LEGAL name now, which is married name. For my wife we did first name, old last name as middle name, and my last name as her's

For us, when applying for AOS, we used her legal name as Hank said. It went from FIRST/MIDDLE/LAST to FIRST/LAST/MARRIED.

Be advised, this seems to be the PI "norm" when getting married. There have been some posts about folks having issues with names because they did FIRST/MIDDLE/MARRIED, because the folks generating passports don't want to recognize the US naming convention.

ETA: Darn VJ keeps adding new posts to old ones suddenly. Wassup?

We got married (she was here more than a month), and went to the local SSA office. Took her passport with her maiden name and marriage license her new legal/married name, and applied. When we got the card, it was in her married name. Pretty simple (minus a SNAFU we had where the post office was returning random mail for us at the time).

Also, we had nothing to prove she was authorized to work, as we had not filed for AOS yet. But perhaps the SSA knows a K-1 will be allowed to work eventually. The verification was done online, in-place, as far as I could tell. The lady behind the counter looked SOMETHING up on her computer, noted the name change due to the marriage license, and we did not have to get 2 cards, one maiden, one married. And I assure you, I did not bully nor coerce the young lady. Just handed her our papers that she requested.

And I didn't "lean on" the man behind the counter when my wife applied either. My wife handed him the forms and passport he looked her up on the computer, was pleasant as we chatted a little while he completed things, then it was - card should arrive in a couple weeks. Which it did in her married name.

Its not complicated, even though someone wants to make it seem so. ;)

It happens the same to me.

I went to the ssa office and they dis my card with my married name, even though i dont have my gc yet.

Now i need my drivers license for the state im

Living in andi cannot get it because my name on social security card doesnt match with my passport or my employment authorization or any of the documents from the uscis that i brouhght.

Im still at the dmv sad and frustrated trying to check what to do.

Here at the dmv was told to go to the ssa and have my ssc change to my maiden name. And when the uscis change my name to married name change everything again (ssc and driver's licnese)

So be careful....

So be careful....

DO NOT go to SSA to change your name.

As for DMV you simply need to wait until you get your EAD or green card.

Hi Hank.

I think i might way.

In other topic somebody told me that dmv should check with uscis and no problems.

I received a letter from uscis stating that i might have a decision within 150 days. More time :( feel so tired of it.....

Your timeline is rather lacking, when did you file AOS, did you submit the I-131 and I-765 at the same time? The EAD/AP combo card usually arrives 2-4 months after filing.

Im gonna work on my timeline today.

I send everything on the 1st april. They received it on the 3rd. My biometrics were in may 1st.

I already received my EAD. In june. And in July 10th a letter stating that my case will be delay for 6 month.

I called in december and january for servive request and received that letter this weekend. So im waiting my interview and mi greencard!
