Question on timing the application

We will be eligible to file the N400 on Feb19th 2013 based on marriage to a US citizen.

The question is, we wont have filed 3 years of taxes by then (we have filed 2010 and 2011 but 2012 is not due by the date we want to file the N400).

Is that a big issue? Do they really need 2012 taxes seeing that it will not even be required by the IRS until Apr 15 2013?

Any advice would be appreciated.

The deadline is April 15th, there is nothing stopping you from filing in January!!

You can include the tax transcripts for 2010 and 2011. For 2012, you can include your draft tax returns and put a note on them saying that this is your current draft and that you will file by April 15, 2012. If you are sure that you will file for 2012 this anyway and there will not be any changes, then you can file for 2012 before you send in your N400 application and include copies of those final returns.

I have a pretty complex tax situation by owning multiple businesses - it usually takes a couple months to get all the documents in order

I will file by the 15th Apr but prob not by the 15th Feb

The deadline is April 15th, there is nothing stopping you from filing in January!!
