I'm going to post here as well and see if any Canadians can give me their take on the situation...

My Fiancé and I are about to send in our package, and I have my vacation booked to see him for Christmas. Since we are only JUST mailing the I-129F petition, I'm wondering if when I cross the boarder should I mention that we have just applied for the K1 visa and are awaiting our approval?

I don't want to go to the boarder and say I'm visiting a 'boyfriend' when I've just applied for a Fiancé visa, but at the same time because I'm driving to North Dakota (2 hours from me) and flying out of there to save money, I don't want to be turned away from the boarder.

I am only going to see him for 2 weeks (dec.22- jan 7) should I still bring a letter from my landlord just stating I've given her post dated cheques and a letter from my employer stating I am due back at work in January? I worry far more than I probably should but i just want to make sure I get there for Christmas with him and his family.

Yep gets asked a lot-- All comes down to the POE officer!! Most have no problems visiting. 1 should ALWAYS have proof that ur going to return to Canada. My 2 cents is down below in my signature

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I think it will be an issue if you tell them you are driving down and flying back (if that is what you meant to say). What is going to happen to your car? What you call your significant other does not matter much, as long as they believe you aren't staying.

I think it will be an issue if you tell them you are driving down and flying back (if that is what you meant to say). What is going to happen to your car? What you call your significant other does not matter much, as long as they believe you aren't staying.

Many people do this---airfare can be a lot cheaper

she said she is driving to North Dakota and then flying from there to see her boyfriend (who most likely lives in another state).. I am assuming she is leaving the car at the airport in North Dakota.

Here's what happened to me:

We got engaged in November of last year. We didn't file the I129-F until February. I went across the border by land, to take a plane from Buffalo to Florida with my fiance (who had been living with me at the time) for Christmas. My uncle and cousin drove us. (Knowing what I know now... this was definitely a risky situation).

The border agent took all our passports and asked how we knew each other (everyone except uncle and cousin had different last names) - My uncle said that he was driving the two of us to the airport, and he and my cousin would be back that evening. So then she focused on us. Tom (my USC Fiance) told the agent that we were engaged, and going down for Christmas, and that he would be staying in Florida, but I would be returning with my parents, who were driving home (!!!! Even riskier, no return ticket).

She focussed on me for a while after that, asking what I do for a living (I was smart enough to get a letter from my boss saying when I would be returning to work), and I had a few paystubs and bank receipts with me. After a bit of talking (very calmly) - she told us that she believed us, but that next time (and every time I cross the border), I should have all my documentation proving that I would be back in Canada while we waited for the paperwork.

It is *totally* up to the border agent whether or not he/she believes your story, but you should always present proof that you will be returning to Canada - and you should bring as much as possible. (Since then, every time I've crossed, I've had a letter from my employer, bank receipts, pay stubs, my tax assessment on my condo showing that I have property, and my entire package that I've submitted for the K1 visa ... and every time I've travelled since then, I've NEVER been asked for it. But better safe than sorry!)

I posted in regards to your other post, but I will answer here too. I have never had an issue crossing the border. I have driven to Seattle and parked my car there and flown to see my fiance. When I cross the border I just answer the questions as they're asked. Usually it's "where are you going, for how long, who are you visiting, how do you know each other" It's pretty straight forward and I've never had an issue. If they ask why are you flying from that particular airport, "because flights are cheaper". Always be honest and don't give them any more information than what they ask for.
