Hello VJ community,

I am filling out my I864 (I am the USC petitioner) in preparation of the next steps. My question comes with regard to listing my income. I am living in the UK with my UKC spouse, where I work earning roughly £900 ($1,400) monthly after taxes. This income will not continue once we move to the US; I do have a job lined up in the US, but it will not begin until we have made the big move. For financial purposes, we will be using my father as our joint-sponsor.

I've sent an email to the USCIS asking this question, but I've not heard back in over 2 weeks. Can someone please tell me how to go about Part 6 on the i864 regarding my employment? Do I list my current employers & income, despite the fact that they are both UK based & will not continue after we move to the US? Or do mark this section as 'umemployed' and 'zero' income?

Any help would be hugely appreciated!

This is an excellent question and the answer is that there is no clear answer. You are instructed to enter the income you are using to meet the requirement. Your income that won't continue, will not be used to meet the requirement, so it won't be counted. I recommend entering the employment information and income (before taxes, not after) anyway as it shows a more responsible petitioner than if you indicate "unemployed" which isn't actually true. You can just indicate the income will not continue, either on a cover sheet or not at all. The submission of an affidavit of support from a joint sponsor, speaks for itself.

Don't forget to include evidence of your intent to re-establish US domicile.
