My fiancé's son will be 21 years old in February 2013. The DS_156K form requires listing all unmarried children under 21 and provide a copy of their birth certificate. Our problem is we can not secure a copy of the birth certificate. Her divorce happened when the child was just two years old and she has never seen the child since. The divorce was very brutal on her and her ex-husbands family had the Hukuo books, including hers, changed to erase any evidence of her giving birth to the child. However, on the original I-129F petition we included the sons information so there is documentation of his being.

We have to return the Pack 3 to Guangzhou soon and will have the interview before the sons birthday which causes the problem of not submitting all of the required documents. I am thinking of making a notarized statement of facts regarding her sons birth certificate and requesting a waiver of the requirement. I'm hoping this will be accepted being as it will be only two or three months before his twenty first birthday when the requirement would lapse and no longer be required.

This is causing my fiancée great stress and anxiety and we really need to move past it.

Anybody have any thoughts, suggestions, advice, etc. to help us get over this hurdle?
