Hey guys! I have a question.. So I received an email from NVC saying that my wife's visa application is now eligible for processing.. Now they are letting me pay an Affidavit of Support processing fee of $88 plus they wanted me to establish a communication with them and register the name and the address of my agent.. The thing is I have not received my NOA2 from USCIS in the mail.. So how is this? Can I push through with NVC without the NOA2? If so, what is the first thing that I have to do?

Your response is very much appreciated. Please help. Thanks.

regardless of whether you received your hard copy of your NOA2, NVC already has your case and i'm assuming they sent you the case number and IIN in that email. you may proceed with payments and the sending of the next set of packets. call them up and give them your spouse's email address. they will be sending you both emails once you do. good luck! :)

Yes we did receive them.. So what will be our next step after receiving the email? Do I pay first? How about sending the next set of packets? Will the NVC send me a new set of forms?

log on to the payment portal. you will find you AOS fee invoice already generated. pay for the AOS fee...once status is updated to "PAID", print the cover letter and send in your AOS packet.

your beneficiary should be sending in the DS-3032 (choice of agent form) right now. once they accept that, log into the payment portal again and see if your IV fee invoice is generated. if it is, pay it, wait for the status to update to "PAID", print out cover letter and send in IV packet. (it's been taking more than a week for NVC to approve emails so sit tight)

NVC will not be sending you packets of forms. you will be responsible for downloading and filling those forms up and putting all the documents together.

Ok.. What did you include in your I-864 Immigration Visa package? Because I was reading a thread from VJ about the documents needed and they said an employment letter from my current employer is needed.. What is in your Immigration Visa package?

nope, IV packet is DS-230.

if i was your joint sponsor living in the same household, i have to fill out I-864A.

if i was your joint sponsor living in a different household, i have to fill out the same I-864 that you filled out.

nope, IV packet is DS-230.

if i was your joint sponsor living in the same household, i have to fill out I-864A.

if i was your joint sponsor living in a different household, i have to fill out the same I-864 that you filled out.

I am sorry I did not get that.. Let's make it this way.. I am the petitioner and my mom will be my joint sponsor.. We're both living in the same address.. So in this case I have to fill out I-864A? If I filled out I-864A there is no need for us to fill I-864 anymore?

you as the petitioner will still have to fill out I-864. you as the petitioner will have to submit your employment letter, paystubs, and your 2011 IRS tax transcript plus 2 previous years if you like (2009, 2010).

then your mom who you are living with will have to fill out I-864A. she will have to submit her tax transcripts as well. she will also have to submit a copy of either her US passport, naturalization cert (if she is a citizen), or her green card.

to establish proof of relationship to your mother, you will need to provide a photocopy of your birth certificate.

itemized, your packet should look like this:

1. barcoded cover sheet (obtained after you pay the AOS fee)

2. cover letter (optional but good to have) which itemizes the contents of the packet

3. I-864 of the petitioner

4. employment letter of petitioner

5. recent paystubs of petitioner

6. IRS tax transcripts

7. I-864A of your household member/joint sponsor (your mother)

8. IRS transcrips of joint sponsor

It is recommended as proof of your employment. It's ultimately up to you, but if they send you an RFE for it, it will definitely cause a delay in processing your visa. I wanted to be sure so i included one and just for reference, i looked into my father's petition for my mom and i in the 1980's and HE even had employment letters included in his affidavits of support. It's tried and tested by decades of petitions. Not my place to test whether to include one or not. I would just follow what everyone has done if it means getting closer to a visa, IMHO.
