Hi There,

My USC fiancé is currently unemployed and due to health reasons has been since the middle of 2010. However he is not currently claiming benefits/support from the US government.

The most recent tax return transcript I have for him is for Tax Period Ending Dec 31st 2010 (the last time he was working)

Therefore a good friend of mine, who is self-employed, has agreed to be my co-sponsor and complete the i-134 for the K1 visa. I have so many questions and if anyone who has been through similar situations could offer their experiences I would be so grateful….

1. Has anyone successfully used a co-sponsor for a K1 visa. I am hearing so many mixed opinions on this and it seems to differ from country to country.

2. Does my fiancé also need to complete an i-134, despite the fact that he will NOT be sponsoring me nor does he have any employment details or savings, property, stocks, bonds etc? if so what supporting documents could possibly be required?

3. Aside from the i-134 what supporting documents does a self-employed co/sponsor need to provide?

Please be as detailed as possible because I am totally panicking right now and I have found that the instructions given in the official document of support for the i-134 are quite vague and not helping to answer my concerns at all.

1. Plenty of people use co-sponsors successfully. There are consulates where it's more difficult to have them accepted (and some where it's not allowed at all), but London is not one of them. :)

2. Yes. Even though your fiance does not meet the requirements, he will need to fill out the form. If he has no supporting evidence to show, then there's nothing to include. I'd include the last tax transcript you have for him and perhaps a letter explaining his situation.

3. Your co-sponsor needs to supply any evidence that proves his income. Since he is self employed, tax returns/transcripts will be the best evidence to show. If he can show any bank statements or pay stubs if he receives them, those would help too. Anything to prove he makes what he says he makes, basically.

1.Yes, all the time in London.

2. No. London wants a sponsor. If not fiance, then somebody else will do. This answer does not apply to the I-864 Affidavit of Support that will be submitted with the greencard application. For that one fiance/husband will do one as well as joint sponsor.

3. I would choose the latest tax return as the best proof of income since a self-employed person does not have an employer or get a salary check (pay stubs). One tax return will do for London with no other supporting documentation. 2-3 years would add to the credibility of the business, but they will most likely hand those back in favor of the most recent.
