Well my fiance has never needed to file for tax return because he was a student and he wil be graduating this may and will be starting his Permanent Job... will this be a problem because he does not have 3 years worth of tax return?

Because I was told that I needed a co-sponserer but the US EMBASSY SITE SAYS THIS

Q- If a sponsor cannot present three years of tax returns because s/he was not obligated to file, can s/he qualify as a sponsor?

A- Yes. A sponsor is only required to submit returns for years in which he/she was obligated to file. The lack of tax returns if there was no obligation to file does not disqualify him/her as a sponsor. The deciding factor is current and sustainable income. See INCOME REQUIREMENT.

And then this

INCOME REQUIREMENT

Q-Must each of the last three years' income equal 125% of the poverty line?

A-No. The current year's income, supported by employment letters or other appropriate documentation to demonstrate continued employment/income, will govern.

So make me understand this guys... do i need a co sponser when my fiance will be starting perm work this summer so he can support me... or not?

have not started my visa application, have not decided what route to take, planning my trip to America, and asking questions to see what best route to take . *breathes*.

So, do I understand correct that your fiance has not worked in the last three years? No part time work where he SHOULD have filed a tax return? Just need to make sure that his not filing was in fact not required.

But For a K-1 Visa, the instructions only asked for one year of tax returns. But It appears to me from your own research that if there was no required tax filing, then his current income must be substantiated with a letter from his employer. And that is all. I would write a letter to explain why no tax returns were filed because this is very unusual.

Thanks for the reply DX, yes my fiance has never worked not even part time so has NEVER needed to file for a tax return... he will start working this summer for fulltime as far as I know permanent...so from what I read hopefully not wrong could he still be my initial supporter with no need of any cosponser..so basically does that mean he just need a letter from his employer stating his continous job at the place he will be working at and the expected income etc etc?

btw when do I include all of this information ? just at the interview?

He will need to provide the I-134, Affidavit of Support to you when you go for the interview. The instructions that you receive from the Embassy will tell you about the number of years of Tax returns. For my fiance, from the US Embassy in Moscow, her instructions was for me to provide the last year of Tax Returns. I think this is standard for K-1 visa. I did supply 3 years to be on the safe side. It was not big effort. But I would provide a letter to explain why there is NO Tax Return provided.
