Hello everyone,

Probably this topic has been posted before but I couldn't find anything that answer my question so I apologize if you already answered this before.

My story from the beginning. I came here in May 2009 as an au pair with a J1 Visa. After 3 months in USA a friend introduce me to a wonderful man who is my husband right now. We got engaged after 5 months dating and got married a year after that. I was an au pair for 2 years, it ended on May 2011 and I had 1 month of grace until the end of June. We got legally married on June 2011. Then we had another Ceremony in the Catholic Church on August 2011. We have been married for a year as you can see. During this year we had a lot of financial issues due to my husband losing his job 3 months after our wedding. We tried our best to keep paying bills and all that but couldn't filled for my AOS. After that he got another job which was horrible and ended up destroying our car so we were without car and he lost his job again because he needed to provide his own transportation. After that we were again on financial issues and after a month my husband was still without a job so I decided to go ahead and get a job as a nanny even though I was not legally able to work. Right now I've been working for 5 months, we got a used car, got back on track on our bills and my husband got a job.

I know I shouldn't apply for a job, but I just didn't want my husband to feel he was the only one responsable to provide in our family. I love him so much I wanted him to not be so stress out for all this situation. Anyways, now that we are back in track we are ready to fill for AOS. I already got my Medical Report and all the vaccination and we are gathering all the documents and money of course to finally applied for my AOS. So my other question is related to my job. I don't wanna lie to the USCIS because I don't see the point why to do it. On my nanny job, which I am still doing, I am paying nanny taxes quarterly. Would I have problems with my AOS because I worked without work permit? Should I quit my job before I apply or is it okay to keep working? Do I need to write or submit something else due to my job?

Thank you and I hope some of you can help me.

Unauthorized work is forgiven with adjustment of status. Just fill in the forms and answer the questions honestly. In theory yes, you should quit your job until you have your EAD (legally, you should never have taken it). But that's a decision you have to make yourself. It shouldn't impact your AoS either way.

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014
