Nich-Nick,

Thanks for the advice on AOS and for the sample packet! I'm sure that's going to be a huge help for us as well :)

In everyone's life, at some time, our inner fire goes out. It is then burst into flame by an encounter with another human being. We should all be thankful for those people who rekindle the inner spirit.

Initially filed for K1 visa - Feb 23 2012

Due to circumstances beyond our control, we've abandoned this application

We married on Aug 24, 2013 in a small ceremony in MA

We'll be applying for a CR1 / IR1 visa as soon as we are able

Watch this space for updates!

Nich-Nick,

Thanks for the advice on AOS and for the sample packet! I'm sure that's going to be a huge help for us as well :)

Another tip on AOS I learned that might steer you in the right mindset if you're as clueless as I was.--

There's a bunch more people doing AOS from visas other than K1. All of them used to be lumped into one AOS forum, so it got confusing. Better now that there is a separate forum for those already in the US on student, work, tourist visas or even VWP. Those people didn't do a petition to get a spouse or fiancé visa as they were already here. So they do the I -130 petition concurrent with their AOS. You have already had a petition approved and do not do an I-130.

Also forget everything you've done to get the K1 when you prepare your AOS. It's like a brand new ball game and you are the rookies nobody knows. The applications are to new people, new offices, and they aren't looking up anything that you submitted in the past. Act like this is the first thing ever submitted and don't wrongly assume they know you, where you live, work etc.

Following on that line-- if the wife has a new (husband's) last name, use it on the forms whether as the applicant, or listed as the spouse and sponsor for the affidavit of support. There's places to put "former names used" if you are the applicant for the greencard and there is a marriage license that explains Miss X is now Mrs. Y. So don't worry that your paychecks or tax returns have your maiden name. They will understand those applying from K1 are newly married and might have changed their last name. Your application should use the name you plan to use after marriage and not what was on your K1 stuff. Again, it's like starting over so be the name you will use forever forward as a married lady. It's also okay to choose to not change your name after marriage. My husband and I have different last names and never had that questioned by immigration.

When you do a G-325a biographic form, you can start with your saved copy from before but the applicant has a few changes for the new one. He/she is now married, has a spouse name to list, is unemployed (top line of work history), and has a new address in the US (top line of address history). You can start with the old forrm, make those changes, and do a "save as" with a new file name.

Ok, that's the end of my lesson on switching your brain from K1 to AOS. :P
