Hello Eeveryone

I am new to this forum and was wondering if I can get some help. I am a Canadian Citizen and my Husband is an American Ctizen, we just recently got married on June 22 and then on June 24 we travelled to the States for a reception in the USA. I am currently in the USA and want to start the immigration process. I have a couple of question in which I was hoping people can help me out with. At present I am in the USA, but will be going back to Canada to complete some work stuff for about oen year. Does it make sense to start the immigration process right now while I am in the USA or when I get back to Canada? From what I have read I will be starting the CR-1 process. I want to know that when I start the CR-1 process, can I travel back and fourth from Canada and the States? Any information or guidlines regarding this process will be greatlt appreciated.

Hi there! Congratulations on your marriage!

The CR 1 is the proper process for you to go through. It takes roughly 8-10 months to complete, so you being in Canada for the year will be ok. As far as travelling back and forth, we were able to do so fairly easily. Once we got our second approval (NOA2) and our petition was sent to the NVC, we did not have any travel plans, but I believe it becomes a bit harder to cross when they are able to see your intent to immigrate.

I would definitely start the process now. However, if you were staying in the US, I would recommend doing an Adjustment of Status. As you are moving back to Canada for the year, I would have your husband fill out the I-130 paperwork with the USCIS, and go from there. That portion takes about 5 months or more to hear back with an approval, so be prepared for a lot of waiting with not a lot of word as to why.

April 20, 2012- NVC Received petition

May 1, 2012- NVC Case number assigned

May 2, 2012- DS 3032 and AOS invoice recieved

May 3, 2012- Paid AOS bill, submitted DS- 261

May 4, 2012- Submitted AOS

May 11, 2012- Recieved IV invoice, Paid IV bill

May 14, 2012- IV bill payment received by NVC, Filled out DS-260 and submitted

May 15, 2012- IV packet emailed to NVC

May 21, 2012- Case complete!!!!!!

June 13, 2012- Medical appointment

July 9, 2012- Interview Date --- APPROVED!

July 13, 2012- POE
