My husband (US citizen) and I (10 year GC) are now in Japan for his overseas assignment. We have been married for 4 years and I have had my GC for 3.5 years. We are looking into apply for my US citizenship under 319b. However, we have some questions on 319b:

1. Is ExxonMobil (my husband's company) a qualified employer for this purpose?

2. My husband's remaining time in Japan is 17 months. I learn that 319b requires 1 year minimum remaining time before interview. Adding another 6 months for application processing, total 18 months. So now we only have 17 months left...will it be a problem?

3. If after we submit the 319b application, my husband is sent back to US earlier, say 3 months after application submission, will it affect the 319b application?

Anyone who can share a thought would be appreciated.

If you are married to a US citizen you can naturalize at 3 years of permanent residence. Have you lived in the US at all?

If Exxon Mobil is 51% American owned and their head office is in the US, then yes they qualify.

You must have minimum 1 year remaining on the contract, but should your husband find his contract cut short before the naturalization process is complete you must tell USCIS as you no longer qualify under 319(b)

Hope this helps.
