Ok, I have three questions. First is my husband required to get a medical AND a police clearance done before going to his interview, as they would if it was a K1 visa? If he must get the medical done, which form is it that he needs to take to the civil surgeon, the DS-2053 or the I-693, I am confused. Last question is how do I present myself to Immigration, am I called the petitioner and he is the applicant or how do they refer to the two of us? I am trying to write the cover letter and I don't know how to refer to myself/him? Ok, I don't know how to count, fourth question, does Immigration see my husband in the NYSC while waiting for his interview, as good or bad thing? :(B-)

I can only answer one of your questions. Someone else will come around and answer the rest.

You (the USC) are the petitioner. He is the beneficiary / applicant.

Also, you call him your husband and you are doing a CR1 but your signature says that the proposed wedding day is in August of this year. Are you married or not??

If you are married, please change your signature.

If you are not married yet, you are chasing after the wrong visa and PLEASE PLEASE PLEASE stop referring to him as your husband. On here, on emails, on chats, on texts. EVERYWHERE. people have been denied for calling their fiancé "hubby" before they were married.

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

1) Yes, he is required to have those things, but the MEDICAL is the last stage of the game. The Police Certificate should be turned in along with the Long Form Birth Certificate, DS-3032 and DS-230 at the NVC STAGE ONLY.

2) The form he needs for the medical will be forwarded to him by the Embassy once all the paperwork leaves the NVC and is forwarded to the Nigerian Consulate.

3) You are always the petitioner and he is always the beneficiary. The USCIS stage is more about the petitioner. The NVC stage is more about the beneficiary...the INTERVIEW is your husband walking in alone and proving to the Consulate Officer (CO) that you are a true-bonafied married couple...without a shadow of a doubt.

What is NYSC? Is your husband in Nigeria or is he in the United States on a different type visa? Updating your timeline would be very helpful! Remember, if you are married you are filing for a IR-1/CR-1 (which you currently have listed) that requires form I-130 that you will present to the USCIS. If you are only engaged and are sending for your fiancee, that requires form I-129F for the USCIS.

In order...

1_ USCIS...I-130 or I-129F (depending on your visa type)

2) NVC (DS-3032 and DS-230, Police Certifiate -only good 3 months and long form birth certificate, if married)...other forms I'd have to look up if fiancee app.

3) NIGERIAN CONSULATE receives all completed documentation.

4) Consulate sends PACKET TO YOUR HUSBAND/FIANCEE.......for MEDICAL and Interview Date

Thanks so much you guys, that helps so much. As far as my status, we had a traditional marriage, performed by his brother on April 10, 2012, but I know that immigration doesn't see that as a bonafide marriage, but to us it is. I will return in August to have both our court wedding (as requested by his pastor) and our white church wedding on the same day....yikes! NYSC Is National Youth Service Corp. He is in Nigeria still and just starting his NYSC Service next week, that will last for a year, but he will drop out if a visa comes first. Again, thankyou all so much for your patience with me and providing the information I needed. I am still new to this (in addition to my timeline!). :thumbs:

Sk your husband if he has the long form which is the only birth certificate they will accept. It has jut all the detailed information required by immigration.So than you will be filing the I-130 spousal visa. just make sure you have all your evidence nicely put together photos of your traditional wedding. However did you go to registry and register.Because you do need a marriage certificate before you can even file.
