 Hello all,

It’s getting very complicated and stressful. My fiancé is Eritrean but as I stated before the American Embassy in Eritrea doesn’t process K1 visas. We transferred the case to the Nairobi consulate because Eritreans did not require a visa at the time (was able to obtain it at the airport once you arrived in Kenya).  Unfortunately for us, Kenya has changed the requirements for Eritreans, now we must request a visa prior to arriving to Kenya.  My fiancé left Eritrea in September of 2011 for the purpose of this process and is unable to return back to Eritrea. The process was only to take 6-8 months; our timeline was actually ok but with the current AP  status .. :whistle: ?  His visa to Kenya expired several times but he was able to leave to neighboring country and re-enter with no problem. This is not an option any longer, he left Kenya and due to the change returning to Kenya became an issue.  We are working on it but he may not be able to satisfy the requirement for the visa to re-enter Kenya.   :help::help:

 

Hopefully the Nairobi consulate will approve us and request his passport for the visa.  If so…

 

Questions:

1. Can he mail the passport from another country? Is that even legal? Would they accept it?

2. Can we request to transfer his case yet again while it’s in AP?

3. If we have to transfer, any recommendation where?

July of 2010: We met in Eritrean when I was on vacation.

August of 2010: Returned to U.S and we spoke on the phone everyday and still do (very costly).

December of 2010 to January 2011: went back to Eritrea to see him.

January 11, 2011- Engaged.

March 2, 2011: I-129F sent

March 13, 2012: Second interview. Placed on Administrative Processing.

October 16, 2012: Case sent back to USCIS

November 16, 2012 Case reaffirmed and sent back to the Department of State (according to the USCIS SITE)

November 28, 2012 Vermont Service Center received Petition back from Embassy.

March 2013- Returned K1 validity expired. Here we go again.... !

March 15, 2013 Married

April 29, 2013 Filed I-130

May 2, 2013: Received NOA1 via text/email

May 6, 2013: Received NOA1 hardcopy in mail

XX- XX, 2013: Received NOA2 via text/email!!!

XX- XX, 2013: Received NOA2 hardcopy in mail

XX- X, 2013: NVC received file

XX- X, 2013: NVC case number assigned

Wow, I don't even have the slightest idea on an answer. :blink::blink::huh: Kenya won't allow him the visa to re-enter the country even though his case is at "their" Embassy?? That makes no sense to me.

I would email the Embassy and ask them what to do. They are the ones who placed your case in AP, and that's why you're having these issues. Perhaps someone else can shed some light...I'm at a loss...I really am. As far as your questions about mailing the passport from another country, etc., again, I would ask the Embassy what you should do. Maybe they'll have an answer and it won't be as difficult as it seems. I'm not sure if you can even transfer a case that's in AP...I would think that would delay your case even longer. I hope someone else can help out, but if not, I don't see why you can't email them and just ask. Good luck with everything, and I'm sorry for all the stress.

I would email the Embassy and ask them what to do. They are the ones who placed your case in AP, and that's why you're having these issues. I second contacting the Embassy...I would imagine that this would be an issue they'll be coming up with quite frequently if Nairobi is the Embassy Eritreans are supposed to go through.

Ben and jill the us embassy has nothing to do with issuance of the entry visa into kenya,since he is an eritrean national he will have to apply for a visa to enter kenya via the kenya embassy in eritrea,. Also as you said contact the embassy and ask for direction if they need you for a 2nd interview or they need you to mail the docs and passport via dhl.

Hi Rasta. Yes, I realize that...was just saying for her to ask the Nairobi Embassy for guidance since they are in the situation they are in because they are the ones who placed them in AP to being with...that's all. :star: I hope you are well and that your family is now home. Have a great week!
