Hi, my fiance and I are still waiting for our noa2. Our 5mos mark was lap on June 18,2012. He is planning to call uscis this Wednesday (June 20).

So while waiting for noa2 to arrive, I had questions on my mind and it's all about our 6yrs old daughter as derivative (k2), here are my questions:

once we got our noa2, and got the Manila case # from Nvc and pay all the necessary fees.....

1. Does our daughter will have the same medical and interview as mine? coz we want to have an interview and medical schedule same as mine to save time and money going to USEM and ST.LUKES.

BUT HOW?

2. Do the consul/s ask some hard or confusing question to a child? can anyone give an example?

I hope you guys will help us, my child really misses her Dad. I feel what my daughter's feeling when she sees father and daughter together playing. I saw the sadness in her eyes, but I can't do anything, it's crushes my heart.

as long as your fiance mentioned your daughters name on the petition you're good to go, and once you get the noa2 you won't see the name of your daughter there but it is ok. once you get your MNL case # you can now pay your visa and your daughters visa, then you can now set an appointment either online or phone call, after setting the appointment they're going to send you confirmation letter of your interview, you can now do the medical at the same time, good luck :)

If the childs name is on the I-129F, then she will also have an interview but they usually ask very simple questions of children. The appointment is typically at the same time as the K1. Even thoug the child isn't mentioned on the NOA2, she will still be able to go with the parent.

Your fiance needs to be aware that not all call center representatives know how to deal with a K2 derivative and end up sending emails to other people to "see if it's okay" if they can get an interview. I just went through that and ended up having to request a supervisor when I called the second time because that rep just wanted to get me off the phone. After escalating, the rep finally did her job and investigated the case and realized that all was well and we set the interview date for both the K1 and K2. My fiancee and her son will interview together next week.

Is setting appointment online for interview needs different submission? (one for me, and one for my daughter?)

I just wanted to add that for some releasing of K1 and K2 Visas may take a bit longer than the usual 5 - 10 days visa in hand time that we see often here. Well for my case anyways. My Fiance and her daughter were interviewed on May 29th and were approved, but the Visas has not been delivered, upon inquiring USEM the status of their Visas I was told that they were approved and Visas were granted 6 days after the interview, however I was advised that additional verification was needed for the child before releasing the Visas for delivery.

I don't know if this is a standard procedure for K2 needing additional verification or it maybe that the father of the child is of another nationality/citizen (non-Filipino citizen) and they are making sure there are no pending legal(custody) issue or the child maybe a citizen of another country. This was the impression I got when I pushed for answer about additional info needed for the child.

Unaware of this delay, I booked us flights after they were approved and was scheduled to fly to Manila on July 1st with return flight for all of us by the 8th, unless the Visa is received by the middle of next week it looks like I will have to reschedule everything. So it maybe wise to to wait till Visa in hands before booking flight as we read so many times (i did not follow advise :bonk::rofl: ), oh well just need to keep praying it will be delivered by this week.

Interesting. Was the father of the child listed on the birth certificate in your case? I sure hope that you receive the visas prior to your scheduled departure.

And I do plan to wait until visas are in hand before booking flights. I've read so many stories here on VJ about unexpected visa delivery delays.

Yes the father was listed and with signature on the BC.

I got excited :lol: and I figured more than a month would be enough. They told me to follow up Friday so I think it will be getting release by this week..

now, I don't know what would I feel, got a call from my fiance he told me he got a text message from uscis saying our case was updated

then he told me to check the uscis website and I see RFE button.. I know I should be happy coz at last our paper was moving..

I don't know yet what rfe they need.

@CRISTIFUR - my daughter is his child, we're 8.5 yrs in relationship, our child is 6yrs old now.. In my case I guess they will not need some legal custody check coz the petitioner (my fiance) and the primary beneficiary (me) are the parents of the k2 derivative.

our child carry his last name but we're not married.

my fiance is also a filipino and naturalized as USC

he is not born USC.

we're not married but he claimed the child as his child and put his last name for our child in child's bcert. (paternity)

but as I said when the child was born HE IS NOT YET a USC.. he was naturalized and filed i-129f for me and put our child's name too so that it will receive k2 visa as derivative.

we're not married but he claimed the child as his child and put his last name for our child in child's bcert. (paternity)

hi please help me with this situation:

The petitioner (naturalized USC)of k2 visa holder is the biological parent.. lots say that the child is not eligible for the k2..

but this processing for i129f is 5mos already and noa2 is nearly arrive.. if ever that the child is not eligible for k2, what we should do to have the same interview with the k1, are we have any other options, or consideration since the child is only 6 and no one will take care of her once the k1 will fly to the US.. I heard there was the same situation like this k1 and k2 and the petitioner is the biological father.

I hope someone will read this and help us to have options and good advice I really need your help so we can do what's the best for our child to accompany me on interview and fly.
