Yes, in theory filing in July would be perfect as far as timing. But since my fiancee will be coming from a country like Saudi Arabia (i've heard horror stories of foreign workers that encounter all kinds of difficulty and delay just trying to exit this country), i would rather be prepared for the worst case scenario. Thanks so much for your replies though, they really are great help :)

Like what? Something that could delay her for months?

Sadly, foreign workers are just not treated fairly let alone prioritized in the middle east, especially filipino workers. As an example, my fiancee's actual end of contract month is in November. But she doesn't expect to make it back to the philippines til late December, why? Because her employer could care less and they'll take their sweet time in processing her exit papers and tickets and such.

Sorry to hear that. Would it not be less worry to just file in a month with consideration to your fiancee's contract end date and when she thinks she will actually be out of the country? It seems that would be less worry and hassle.

Yes, that is beginning to seem like the smart thing to do. It's just that a month of delay is another month of waiting for us to be together. *sigh* We will definitely discuss it though and figure out what our best options are. That is why i am trying to find out what the grace period is between her getting her mail from the embassy and her submitting all the documents back. If she has a couple of months to do this then i think we are safe with our original plan. If she only has weeks then maybe i will need to adjust my petition submission.

I don't believe it is weeks.

Ok, so I just did some googling, it appears it (the NOA2) is valid for 4 months and there will be an expiry date on the NOA2 hard copy.

So if you file say July 15 ; July 15 , August 15, September 15 , October 15 , November 15 , DECEMBER 15 (expected NOA2) and it will be valid until April 15.

Thanks BrittandDan and RK_and_Inday for your responses. Both make a lot of sense. But just for my peace of mind, i was wondering, after the embassy contacts/sends the forms and checklist to the benificiary how much time does she have to complete the forms and send it back to the consulate? My worry is my fiancee is scheduled to fly back to the Philippines Dec. 30, what if the forms/checklists were sent to her home address say a few weeks earlier? Does the embassy issue a due date for returning all documents and forms? Again i apologize for being so nitpicky, i just want to do everything right the first time.. i'm sure you all can relate. Thanks again! :)

If by any chance your petition got approved by uscis, gets forwarded to nvc and then saudi consulate and she already have to leave back to PI, you can always request to get it forwarded to manila consulate for the rest of the process. I now this coz mine got sent to Bahrain so i had to get it forwarded to manila since i was already there by then.

Jnaz--You are welcome. The (Manila/Philippines) embassy typically does not send the forms and checklists. This info, however, can be found online in the links below:

http://photos.state.gov/libraries/manila/19452/public/Revised%20K1%20Instruction%20Packet%20_3__rtf2_005.pdf

http://photos.state.gov/libraries/manila/19452/public/K1instructionTag%20rtf3%20_2__rtf2_007.pdf

which can be found at the bottom of the following page:

http://manila.usembassy.gov/wwwh3238.html

So the beneficiary can actually start gathering/preparing much of the documentation prior to getting petition approval notice. Thus the time factor should not be a troubling issue.

RK and Inday

P.S. CFO. She will also want to be aware that fiance(e)s/spouses are required to attend CFO guidance and counseling session as a pre-requisite to departure. See details here:

@Jnaz--Also, after Manila consulate receives petition approval notice from NVC and after visa fee is paid, you/your fiance will have choices as to when to set up interview at Manila consulate. Again, if you/your fiance start preparing now, as long as appointments are available, your fiancee could reasonably have an appointment soon after (within weeks) or later (months). In our own case (RK and Inday), our petition notice was recieved at Manila Consulate in mid-August and we scheduled interview for mid-October. So, also, you can have months to work with if need. Punchline: after receiving approval notice about 5-6 months from now you will have some degree of control as to timing of interview, from weeks to months as per your personal situation. --RK and Inday.
