I'm a LPR who filed a petition for my wife on DEC2010. Our son was born abroad on March2012 and the case was approved and sent to NVC on April2012. AOS+VisaApplication fees were received the same date but have not been paid. I sent the child's birth certificate last week. Now, my questions are:

- Do I have to do anything else to include my child in the petition?

- Does he need a separate I130? If so, does that mean going through the full process separately, including the long wait for approval from USCIS?

- I've read different oppinions about the "derivative beneficiary" applicability in these cases. Any comments?

- Should I pay the fees that they sent me or wait for new fees to arrive?

- Will my petition be delayed by any means?

I know these cases are not common. I appreciate your help. Thanks in advance.

You need not file separate I-130 for your son that will be added in to your spouse's application as derivative. Just send your son's birth certificate and copy of passport, if its avaialable to NVC

Wait until NVC generates IV fee and pay later.
