"Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage"

I will be traveling in July to see my fiance' and get married Lord willing. I arrive July 12 at 10am. Appts all look like they are only available in the morning until 9:30am and they are closed the next day. I cant stay over the weekend. Is there any other way to get the "Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage" before or will they take a walk in for this?

17-Dec-11 Met my wife for first time

24-Jul-12 - Married in Philippines, Honeymoon in Hong Kong

20-Sep-12 - Return to Philippines for visit/Medical/finish up i-130

2-Oct-12 - I-130 Sent (Fedex)

3-Oct-12 - Received at Phoenix Lockbox

09-Oct-12- NOA1 email/SMS : I-130 transferred to NBC

12-Dec-12 - File appeared in Case status

25-Dec-12 - Returned to Philippines for Christmas and New Years

4-Jan-13- Learned my file was transferred to local office on Nov 27

17-Jan-13- I-130 Approved

Usually these affidavits are given also at extension consulates in some provinces in the Philippines, where are you going to get married coz I know someone who did it on a walk in basis in Cebu Consulate. Good luck :)

DISCLAIMER: Philippine Law requires non-Filipino citizens to obtain a Certificate of Legal Capacity to Marry if they wish to marry in the Philippines. U.S. Consular Officers cannot make any official certification about the status or eligibility to marry of persons residing in the United States who propose to be married abroad, or about the laws of the United States or of any of the fifty States or Territories about eligibility for marriage or the solemnization of a marriage. Instead, the U.S. Embassy provides an Affidavit In Lieu of Certificate of Legal Capacity to Marry. The affidavit is the only document the U.S. Embassy is able to provide. If the local registrar refuses to accept the affidavit, there is nothing that the U.S. Embassy in Manila can do. It is the applicant’s responsibility to verify directly with the local registrar their requirements.

In late 2011, the U.S. Embassy learned that the following local registrars had refused to accept the Affidavit In Lieu of Certificate of Legal Capacity to Marry as a viable alternative to the Philippine document: Makati City, Quezon City, Davao City.

C. There is a 10-day waiting period from the filing of the Application to the issuance of the marriage license so you have to anticipate this period of time and make use of it for other things.

If you are arriving July 12th and get the documents you need by July 14th you would have to wait until July 24th to get married.

It is always advised to plan to stay for atleast 21 to 30 days if you are getting married in the Philippines

Thank you for the information. I will be in Philippines for 18 days and travel between manila and Gensan. I may just need to travel a day early and get an appointment.
