Can K1 beneficiary wait out the time in the states?

My fiance's another one who was able to visit with no issues. He came for the first two weeks of April with his boys. If we're not at NOA2 stage he'll be back for August. They didn't ask for anything, not even paperwork saying he could take his boys out of the UK. Maybe they saw all the other trips he's taken here? I had a lot of questions on my last trip to the UK so it's all up to the officer.

Initially filed for K1 visa - Feb 23 2012

Due to circumstances beyond our control, we've abandoned this application

We married on Aug 24, 2013 in a small ceremony in MA

We'll be applying for a CR1 / IR1 visa as soon as we are able

Timeline

Yes she can. I have just back from a 2.5 month trip seeing my fiancee in California.

I am also planning to fly back again in June to see her as I think my interview at the Embassy will come through some time in August.
