My fiance put his birth place and date his birth certificate was issued in question 10 on the I129f and he checked birth in the US since he was. Will this create problems or RFE?

That would make him a US citizen and not eligible for any type of Visa to enter the USA. He should obtain is US passport. ( if he is the beneficiary )

Oh, are you asking because the blank is for naturalization certificate information but he put birth certificate information? No, if the right box is checked I can't imagine it will be a problem, although you never know.

That would make him a US citizen and not eligible for any type of Visa to enter the USA. He should obtain is US passport. ( if he is the beneficiary )

But the I-129F is filed by the US citizen petitioner--question 10 asks about the citizenship status of the petitioner, not the beneficiary.

The question does not require a birth place and date or certificate number if the answer is birth in US. That is for a naturalization certificate. I don't think it will cause problems if he checked birth in US and included a copy of his birth certificate. Example I-129F

He is the petitioner.. The USC with a US passport.. He just put in BCert. info in the section that says ONLY for naturalization..

He did check the box correctly and did attach a copy of his birth certificate with the paperwork.

He did check the box correctly and did attach a copy of his birth certificate with the paperwork.

They will probably be able to figure out what he did then. They try not to issue RFEs for insignificant mistakes, just ones that keep them from covering all the bases. Do encourage him to be more careful in the future though.

The OP left NO detailed information as to what the situation was if the person was the beneficiary or other wise. This is why I answered the way I did and put in brackets if the person was the beneficiary.

Poor beneficiaries. Sounds like laziness on the USC's part IMO, but that's just my logic speaking. I see your point though.

Poor beneficiaries. Sounds like laziness on the USC's part IMO, but that's just my logic speaking. I see your point though.

I could scream lazy on my husbands part - I did ALL the forms but, he works for the military pushing paper all day already. So cant really blame him for not wanting to do extra gov forms/papers at the end of the day.
