CR-1 walk through to interview,

Timeline

This is my story as it stands, UK to USA

met my soul mate (wife) in March 2009, we talked every single day online and by phone, MSN, E-mails, Skype, have all chat logs phone bills and e-mails, we both got engaged June 2009, I applied for my passport August 2009, passport granted september 2009 (wife) paid for plane tickets in August 2009 for Octorber 16th 2009, trip was Octorber 16th 2009 to January 12th 2010, (89 days) spent 89 days in USA and returned to England UK, (wife) booked flight on Febuary 5th 2010 for Febuary 10th 2010 to May 8th 2010, (88 days) also booked wedding day for Febuary 16th 2010, boarded flgiht febuary 10th 2010 and landed in USA, got married Febuary 16th 2010 got videos photos etc, Stayed in USA until May 8th 2010 and came back to england UK,

this how my story goes,

july 8th 2010 Applied for B2 Visa, refused due to lack of Evedance of me comming back to england afterwards,

July 23rd 2010 sends forms I-130, K-3 visa, off to USCIS everything they needed,

USCIS granted my I-130, granted K-3 visa,

goes to NVC K-3 got disposed off, carries on with I-130,

sends off Visa interview appcation form,

NVC makes appointment for interview Octorber 12th 2011,

NVC asks for Co-sponsor info misplaced it,

dose medcial appointment in london,

gets shots in which i was missing,

goes to london for visa interview, with Co sponsor papers in hand,

goes for interview,

gets told Co-sponsor does not make enough to Sponsor you,

gets handed I-601 for Crimes i did 15 years ago this August,

gets told need to renew my police Certifcate,

my wife has asked everyone she knows if they could sponsor me, we dont need them for any fincail input, as my wife can support me on what she gets, I also have 3 web sites which are bringing in money but in small amounts, plus i am a handy man who can pritty much fix anything, cars, lawn mowers etc i have nothing to show that i can do these things, all we need relly is a name on a bit of paper to show that i will not be a drain on the public system, Once I have entered the USA "once able to" I look for work or train for work,

another concern I have is after Octorber it will be 12 months since any action has been taken on my immagration, and if I have got this correct we would have to start the entire process all over again,

If i still cant find a Co Sponsor how much money would I need to gather in order for me to immgrate?

if I get my I-601 approved would I be able to get some kind of visa so I can at least vist ? until we can start the process all over again,

because the last time I saw my wife has been 2 years ago this May 8th, the stresses of being apart from each other is taken its toll on us, and the 2 younger children are showing signs too its not easy on them as they dont understand,

so if anyone can help or at least point me in the right direction would be grand,

Your story is making me sad. Can your wife get an additional part-time job just until you are able to move over? Are the children both of yours? If not, does she get child support and did she show proof of that income? Do you pay tax on your internet businesses? If you can prove that your income will continue from those sources even after you immigrate to the states, you can add that income to your wife's. You can use assets in addition to income to meet the guidelines...so let's say she is $5000. short, you would need $15,000. in assets (3 times the difference) Assets can be yours & hers combined.

I am trying to brainstorm any ideas that might help...what a tough position to be in.

As far as starting over, you won't have to send another I130 and wait for that again, you would start at the NVC stage, so not so bad.

The I601 is complicated and takes a lot of time to prepare. Your wife has to show how she is suffering extreme hardship because you cannot live with her in the US. You will also have to show your rehabilitation, but since your conviction/s were so long ago that shouldn't be too hard to do. If your convictions weren't too serious, a good strong waiver can overcome the inadmissibility, maybe needing an attorney/solicitor's help, but it can be done.

First, concentrate on the financial stuff and then the waiver stuff. Maybe try to get your wife over there for a week first so you can spend some much needed time together. Don't give up hope just yet. :D

I just realized something else...you entered the US. You may have a mis-rep also which needs a waiver as well. Did the interview officer mention this to you?

I just realized something else...you entered the US. You may have a mis-rep also which needs a waiver as well. Did the interview officer mention this to you?

no all she said is because I am married to a US citazen I am granted the I-601,

my wife is unable to come to England, she has 2 younger children, and she has 3 (18) (16) (12) older childen from a marrage before, both fathers will not grant the children to come to england, and if she does come here on her own they will both file for abandenment of the children and she will lose them,

my wife is disabled and is unable to work, she has good medcial reasons for the I-601, she has already used the childrens income for the Alfadavid of support, the 2 who are under her care, she does have the 18 year old living with her, we tried to get his W2' and pay stubbs but his place of work wouldnt give them to him,

my web site are new and are only just started in the last few months and havent earned enough yet for filing taxes,

these web sites is what i would use to increase my income, or help at least,

Did the 18yr old file taxes for 2011? How long has he been working there and is it on-the-books?

the 18 year old has been working for almost 2 years this september and it is on the books and filed taxes this year,

If he filed taxes then you just need to order a transcript from the irs. He will also need atleast his most recent paystub showing year-to-date income on it, or a letter of employment. With his income, does your wife qualify? That's your ticket if she does..

Also, call uscis and find out how long you have to file the waiver since your visa was denied last october. I had heard that london tells people 90 days, but in reality it's longer than that..also tell them that you need more time to prepare the waiver and would like to keep your case open. Ask if they can extend it. It can't hurt to ask...you need to buy more time.

I mentioned the mis-rep because if you have convictions you can't use the VWP to come to the states...the officer who adjudicates your waiver will know this and can deny your waiver for mis-representation (of material facts). On the I-601 there is a long list of reasons for the waiver, so check off ALL things you think you might be inadmissible for. One waiver covers everything for one fee, otherwise if you fail to check something off you will have to file another waiver for that inadmissibility and pay another fee.
