Brief Summary of Finance Visa Filing:

10/22/11 - Mailed Complete I-129F form and all related documents

10/26/11 - Received NOA1 confirming receipt.

03/20/12 - Received NOA2 (I-797) - APPROVED

As of 4/18/12 the NVC has confirmed that they have not received the petition filing from the USCIS. An inquiry was sent on 4/11/12 to nvcresearch@state.gov along with a scanned copy of I-797 form. Email response from the NVC on 4/16/12 stating approved petition has not been received and an inquiry will be sent to the USCIS on my behalf but I have not received a response to date. I've heard from friends who went through this process that once the NVC issues a case record number, the consulate in Manila, Phillipines moves fast. My biggest concern is that my finance is pregnant with my child and the doctors may not allow her to fly beyond mid-June 2012. What are the chances that this entire process including consulate interview and issuance of the finance visa will be completed by June?

Additionally, I'm looking for guidance in the event that the petition process is delayed further. Considering my child may be born in the Philippines what steps should I take to obtain either a passport or visa for my child so that mother(fiance) and baby can fly together?

Any guidance or input is greatly appreciated. Thanks!

Assuming that you're a US citizen, your child will not need a visa -- just a passport. Which the baby will be eligible for once you do a CRBA. Read this and this.

It's likely to be completed by June -- unless they just can't locate your file, which has happened. Just stay on them (NVC) daily until you're undated that your file has arrived.

THANK YOU! The CRBA form appears simple and straight forward. It sounds like I can file the CRBA here in the U.S. but will I be required to fly back to Manila?

At this point, I'm crossing my fingers hoping the USCIS moves the petition to NVC without any further delays!

The CRBA must be executed in country -- before a Consular Officer. Either you or your fiancee must personally be present with the application and relevant documents in hand, you do not have to personally be there.

Unsigned, completed Application for CRBA (form DS-2029). Only the child's biological parent or legal guardian, preferably the U.S. citizen parent, can apply for a CRBA. Either parent, including a non-U.S. citizen parent, may execute and sign this application form before a Consular Officer. If it will be signed and executed by a legal guardian, a special power of attorney from the parent(s) or guardianship affidavit must be submitted. Please read and follow the "Instructions Page of the CRBA form" when filling it out. Complete items 1-15 but do not sign this form until you are standing before the Consular Officer during your appointment at the Embassy. Click here for the application for Consular Report of Birth Abroad (form DS-2029).

Try to send your inquiry with this email address: NVCINQUIRY@state.gov. That is the address we used when we inquired ours. We got approved March 19. April 6 NVC received our petition and April 13 we got our case number. I am a spousal visa though.

Isn't there anyone that we can contact to help expedite this process considering that we are now beyond 30-days of the approved petition date?

Did you also try calling NVC? We got our Manila case number by calling NVC.

Yes, I've been calling the NVC everyday for a status. By hey stated that they cannot issue a Case Record Number until they receive the petition filing from the USCIS which they confirmed they haven't received.

Oh okay. They are right. Maybe you can also try calling USCIS again for follow up. Good luck and hope you will have it soon.
