Hi,

I am new to visajourney and am hoping this is the right place to post this query. I am in the process of applying for my immigrant visa. My wife (a US citizen) is living with me in India and we will be submitting the i-130 petition at the New Delhi USICS. She will be going back to the US soon after that due to some family issues. I have the following queries:

1. Should we prepare 1 single file for the visa application? We have prepared something like 400+ pages of chats/emails, 50 pages of pictures, 10 affidavits of people who know us and some other documents. 1 file would be a huge file! Or is it ok to break it up into multiple files and then put them into 1 large envelope?

2. With my wife returning to the US shortly after the i-130 submission, would that lead to any complications? Would they be mailing her stuff to my address? I could always forward them to her address in the US which is still to be decided since she needs to rent a new place when she goes back.

3. When my wife goes back to the US, she will take up a job. She does not have a job at the moment and hence no income. Once she gets a job, she would be able to provide the affidavit of support. IF her getting a job gets delayed, will it adversely affect my visa application? Would I have to show enough financial resources to show that I can support myself in the US?

4. As for third party affidavits of people knowing of our relationship, I am providing 3 affidavits from family members, 3 from my school friends, 1 from a neighbor, 3 from my office colleagues. Is this enough? My wife's side of the family is sending a couple of affidavits but the mail is taking forever. Should I submit the scanned copy of those affidavits until they are here?

You will want to differentiate your evidence. Group emails together, group chats together, group pictures together, and group the affidavits together.

Her returning to the US shortly after submission of the I-130 will not be an issue. In fact, it helps the domicile requirement on the part of the petitioner.

For you to receive a visa, your wife must meet the sponsorship requirements. If she cannot meet the requirements on her own, a joint sponsor will be required. The sponsorship requirements are as follows, the current income of the petitioner, a combination of income and assets, or assets alone must be greater than or equal 125% of the federal poverty level for the petitioner's household size. The I-864P shows the figures.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

December 9, 2025:  N-400 interview - approved
