DCF - temporary resident?

Hello all,

Thanks very much for all the information you've shared about DCF and filing 1-130. My situation is this; I am a Canadian citizen, soon to be married to my US boyfriend, who is in the country on a 4-year student visa. Can we file DCF at our local consulate, even though his visa is temporary, not permanent? If we can't file DCF, what are our next best options? Also, I work as a mariner and routinely come and go from US ports - will this be a problem while our paperwork is processing? Do I need to remain completely outside of the US?

Canada is no longer eligible for DCF. http://canada.usembassy.gov/news-events/2011-news-and-events/august-2011/15-august-2011:-new-immigrant-visa-petitions-filing-process-starts-today.html
