Filing for AOS from an F1

Hello,

I married my wife (a US citizen) back in Dec '06 here in Indiana and hadn't filed paperwork for AOS till now. I want to do this asap and had a quick few questions I was hoping someone could help me with.

1) On the I-485 Part 2 - Application Type (Check one)

I'm not really sure which one I'm suppose to check mark? I'm a Pakistani citizen on an F1, who married his college sweet heart who is a US citizen. I'm graduating this December. Out of the a-j options I'm not sure which one refers to me, any suggestions? I just don't understand their lingo on it I guess.

2) Part 3 - 1 B) been arrested, cited, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance, excluding traffic violations?

I was charged and arrested for a crime back in 2003, but the charges were completely dropped and nothing happened. What should I do? And, back in 2001 I got a Public Intox (PI) (stupid college mistake) but went through the pre-trial diversion program and part of the deal was that if i stayed out of trouble for a year, it would be expunged from my record. What should I do?

Part 2 - (a) ... attach a copy of approval notice, or a relative, ....visa petition filed with this application that will give you an immediately available visa number, if approved

You were charged and arrested, hence you have to disclose it. I would try to get consultation with a good immigration attorney. USCIS cares about minimum possible sentences for violations , you can look it up yourself in the INA.

Whatever you do, do not leave US while your AOS is pending.

part 2 (A) .. what copy of approval notice would I attach?

and i should check mark "yes i was arrested" ? The charges were dropped, nothing happened, case dismissed.. it was a case of mistaken identity.. should i still check mark "yes"? and do you think i'll have problems?

No copy of an approval notice. nemu bolded part of his response for a reason.

Take meauxna's advice, and start your reading with the How Do I FAQ on the USCIS web site. Find the section that applies to your situation - already in the USA, married to a USC.
