Submitted I-129F Jan 18th for my fiancee that lives in Canada. Money order was cashed on the 27th. With that said, she's been in Canada for over 3 yrs but not yet a resident. She's originally from Mauritius. As far as the application process goes, by her living in Canada and not being a resident, would this keep her from being accepted for the K-1 VISA?

She doesn't have to be a resident, but she has to be there legally/lawfully if she wants her interview in Canada.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

She doesn't have to be a resident, but she has to be there legally/lawfully if she wants her interview in Canada.

The visa she is on also must be valid before and after the interview. Generally they will not interview if the visa is close to expiration and the visa will need to be renewed before they will interview.

Your interview took 67 days from your I-129F NOA1 date.

Thanks for the info. She has 1 year left on her current VISA. Just got a letter from the homeland security, they have receipt of petition for my fiance it states that me or her need to fill out a form AR-11. I thought this form was for immigrants in the U.S. changing address? This doesn't make sense at all because she is living in Canada and has only visited the U.S. in order to see her brother get married. Has anyone ever experienced this? Is this a form that needs filled out regardless if she is living in the U.S. or not? Thanks in advance.

Hi there,

My case is similar to your fiance. I live in Canada for 2 years and not resident yet. we are waiting for NOA2. Make sure makes copy of her legall status in canada and some other proof, like taxes return if she works, bank statement with her address, things that show tights in Canada.

Regarding to AR-11, my future husband filled it out when he moved from one city to another while we were applying for k1, theres nothing to do with your fiance.. So, try to find a clear meaning about this form.

You know, I think this is the same case as mine. I'm going to try and fill (AR-11) this out online. Thanks for the info, I'll pass it on. I know she is already nervous, though the interview is still a ways off. Thanks again.

Well got the NOA1 today from my father (scan and emailed) it's dated Jan 26th. I recieved a change of address request from the California Service Center on Feb 6th as well. I went online and changed my address. It's strange filling it out. Since I'm overseas I'll call them Tuesday morning. Hopefully calling them and confirming that my address change is good to go, there won't be anymore issues. Hopefully.
