Hello all

My wife had filed petitions for her parents (my in-laws) about five months ago. We received a letter from USCIS stating that they receive petitions and have deposited the money order. However, recently my father-in-law passed away two weeks ago. Do I need to contact USCIS and inform them of this? How do we cancel his I-130 ? Please advise. Also we have not received NOA1 since past four months. Please help

07/12/06 : CIS Cashed check and assigned a Case# to my I-130

07/17/06: Received NOA1!

I-129F

07/18/06 : Sent I-129F (New form that includes IMBRA Question)

07/26/06 : Recieved NOA1!

Sorry to hear the Sad news.

Here are things that you can do to make the process go faster and get the I-130 canceled.

Your first letter from USCIS, which stated that they have received the petition and money

is your NOA1.

make copy of your NOA1, the type a simple letter to USCIS and put the subject line to

withdraw the filed I-130. Give full details your wife and your father-in-law. Give them

the date of death and have your wife sign it. If possible get the death certificate of your

fater-in-law and attach it to the letter. Make sure you give them your case number in the letter,

which is on that NOA1.

Mail to USCIS, where you sent your I-130 forms. It will be withdrawn in weeks.

But make sure you get the death certificate of your father-in-law in future if you don't have one now,

because they are going to ask your mother-in-law, when she applies for her visa.

Thanks for the quick reply. I do have the copy of Death Certificate. As soon as my wife returns to States, we will send a letter to USCIS requesting a cancellation of Father-in-law's I-130. Will this have any effect on my mother-in-law's I130 process ? Will be delayed because of this ? Just wondering

Also now that we have received NOA1, what is our next step to get my mother-in-law's file moving? Do we need to wait until we receive NOA2 from USCIS? Please advise
