Hi there,

I will file for a I-751 waiver based on divorce soon. I know my green card will be extended 1 year automatically, but how do I do that?

12/07/2009 - I-130 and supporting documents sent to USCIS office in Rome

12/16/2009 - USCIS office received the form

02/16/2010 - NOA1

02/22/2010 - I-130 Approved

05/27/2010 - DS-230 sent

07/19/2010 - Medical exam in Napoli

07/20/2010 - Interview

What do you mean "how do I do that"? It will be automatically extended, you don't have to do anything else than file the I-751 based on your divorce. The NOA will be your 1-year extension. If the divorce is final, you submit the divorce certificate with the ROC package, if it is not final, the USCIS will send you an RFE and give you some time until it is. you will then reply to the RFE by submitting the divorce certificate. In any event you will have to produce evidence that the marriage was entered in good faith, as you would do if you applied based on a still viable marriage. good luck.
