Hello all: I am the foreign beneficiary. After NOA2 approval I understand that my file is forwarded to National Visa Center. The NVC opens a file and assigns a number and forwards to consulate. In my case, it will be the Vancouver consulate in Canada.

Some background: We had hired an immi lawyer at the beginning of our journey. If I could have a "do over" I would choose NOT to. The lawyer has NOT provided good service at all, in my opinion. The other thing I have found irritating is that all notices go to the lawyer, and not necessarily copied to us. So, unless the lawyer advises us of progress we are unsure of what has happened or where we're at in the process. I had signed up for email notification on USCIS approval, which came thru, thank goodness. Most of my inquiries to the lawyer are simply ignored and never responded to.

Question #1: Have you chosen to follow up on your NVC status ? That is, knowing when NVC receives file, processes, forwards it. Or, do you wait for notification of progress ??

I am concerned that if they ONLY correspond with my lawyer, it may delay the process.

Question #2 As the Vancouver consulate appointment is for me (the beneficiary) does anyone know if the consulate contacts the lawyer AND me regarding packet 3 and 4 ?

Question #3: Has anyone "fired" their lawyer ? At what point in the process ? Did this cause delays ?

Call DOS (dept of state ) yourself and ask them if the case has reached or went through NVC and ask for your case number if it has gone through NVC. They can even tell you if the consul has your case and if they have sent packet 3 to you.

If the lawyer is nothing but bad just fire them, ask for all your documents back - notify USCIS/ NVC / embassy whichever part you are at that you have fired the lawyer and steam ahead yourself with things.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

If I can provide all the info (receipt#,names,birthdates) am I able to call NVC to follow-up ? or must the applicant continue to be the enquirer ?

Really? i have done ALL the calling as the applicant/beneficary and never had an issue.. just always asked for the case number, names, birth dates etc then they ask me if i'm the petitioner or beneficiary then i ask my questions!

Go right ahead and call NVC if you wish - i called DOS instead of NVC because at the time people were having better luck with getting information from DOS. You should be able to call on any part of your case and ask questions - not sure why they gave you problems =/

The one time I had to call USCIS, it was application specific (meaning, they didn't want to talk to me, they only wanted to talk to the petitioner). However, they were able to work with me - I had Travis on Skype and he gave his authorization that way (don't ask me how, I used a computer headset and a cellphone and had to line up all the parts, LOL). But, we got it done. Would NVC be able to work similarly with you?

USCIS (192 days, August 24 2011 to March 2 2012. No RFE's).
NVC (30 days, March 12 to April 11. Case expedited due to NVC errors).

Montreal US Consulate, awaiting interview date (14 days, April 12 to April 26).

05/09/2012 - medical in Toronto - passed!
05/22/2012 - interview - passed!
05/25/2012 - visa in hand!!! biggrin.png
06/09/2012 - POE @ YWG (Winnipeg Int'l Airport)

Removal of Conditions submitted March 24, 2014, received March 26, 2014

"RFE" for page 3 of application received, date March 27, 2014. Package re-submitted with all papers re-attached.

04/07/2014 - NOA1 Date

05/07/2014 - Biometrics in Charlotte, NC

11/05/2014 - APPROVED! Citizenship in 5 months!

11/10/2014 - NOA2 in hand.

11/20/2014 - 10 yr GC in hand! :D

Hello my fellow CANADIAN beneficiary, from Vancouver! I see from your timeline that you've been issued your VISA.

In your opinion, was it helpful or necessary to contact the NCV? And very curious, did you guys fire your lawyer?

(We went without a lawyer)
