Hi everyone,

I am new to the forums and need help with getting the proper visa.

I am a Canadian who met my wife while on a trip to the US. We are currently married and I am with her here in the US. What visa do I need to apply for. How long does the process usually take? And am I able to go back to Canada and return to the US without any hassles?

I hope someone is able to help us.

Since you are here she can file AOS for you here but then you do not leave. I do not know how long this takes.

She can file I-130 CR-1 now and you can leave and you can try to return but you may be turned away from entering USA. CR-1 can take 8 months till 1 year.

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

You can apply to adjust status based on marriage to a US citizen. That route I am not familiar with. I do know, with an AOS, you can not leave the US until you have your green card issued. This route also has headaches with proving you married 'spur of the moment' and did not come to the US specifically to marry a citizen to get a green card.

Canadians can stay in the US for six months with out a visa (but can not legally work). If you go the AOS route, apply NOW so you will not be 'out of status' at any time. This link can be helpful, Other AOS info

You can apply for CR-1 visa. You can travel between US and Canada all you want. BUT you must show ties to Canada and prove you will return to Canada until your visa is approved. Even then, it is up to the CBP officer if he/she will allow you in to the US. CR-1 visa can take 6-9 months and in some cases up to a year for Canadian Citizens.
