Hello All,

I received my letter from the US Embassy in London informing me that our K3 petition has been approved - and we're really happy :)

They say our petition is valid for 4 months from the 'date of action', and must be valid to process our case to conclusion.

Does this mean I need to return all my forms, have my medical exam and return everything to them within 4 months or I must have had my interview and had my visa approved within the 4 months?

Thanks,

Andrew and Guia

You should have gotten a notice of approval from USCIS. It has an expiration date on it four months after approval. London will not cut you off on that date, but get started sending in your DS-xxx forms to them to keep your file active so they know you didn't change your mind. Get your police certificate ordered and make your medical appointment. When you have all the documents needed for the interview, there is a Notice of Readiness form to send and let them know you have everything done and are prepared to interview.

If you did nothing for 6 months, they could assume you had abandoned the visa process and use that expiration date to cancel your process. But if you are sending things in and mostly waiting on them, they don't enforce that expiration date. It is automatically extended.

Thanks for your help! I'm starting the forms this weekend, so we'll be keeping it active.
