My husband CR1 with the USCIS the first go around was approved and he went to interview he got blue slip, then we waited and the Embassy denied said our marriage not a real marriage, so went back to USCIS and we waited 120 days just to be denied from them, they ask for more proof of our marriage and how we communicate, so we sent more, the first time we filed we sent a stack of pictures and emails letters all from 2008 and 2009. so when they ask for more info we sent 2010 and 2011 and we took picture of us on yahoo cam showing this is how we communicate and i sent all the mins from yahoo phone, some days over 700 mins but never under 600 mins a day, so we waited while they processed all we sent and then they denied saying not enough proof, said i didn't send nothing but 2010 and 2011, well they didn't say send from start they said more i thought they should have all our proof, but i guess they didn't look at it and record it. My question is, we are appealing it and this is our last hope or unless someone knows what else we can do please tell us. I didn't know what we was suppose to do in the appeal except tell them why they should reopen and look again, i wrote a 12 page letter addressing each word they said in the denial letter. Does anyone know if it will be enough? thanks a lot. the wife who is missing her husband

It sounds like you provided a decent amount of evidence. Are there any red flags that might be causing problems? Have you brought anyone to the US before? Has he tried to get an immigrant visa before? What are the reasons they listed in the letter?

Also, I'm not clear what you're saying. Did you get a hard (white form) denial and the embassy sent your petition back to USCIS with a recommendation to revoke? Because if that's the case, you're looking at waivers now; you can't just re-apply.

USCIS (128 days)

January 8, 2011: Mailed Petition for Alien Relative packet to USCIS.

February 1, 2011: Received Notice of Action 1.

May 16, 2011: Received Notice of Action 2. Case handed off to NVC.

NVC (41 days)

June 24, 2011: Mailed Affidavit of Support packet to NVC.

July 12, 2011: Received checklist letter 1.

(Long delay intentional; not counted in processing time.)

October 12, 2011: Mailed Immigrant Visa packet to NVC.

October 20, 2011: Received checklist letter 2.

October 26, 2011: Mailed checklist letter response packet to NVC.

November 4, 2011: Received interview letter. Case handed off to the consulate in KL.

Consulate

November 12, 2011: Completed medical exam.

November 19, 2011: Picked up results, everything clear.

December 1, 2011: Interview - approved!

December 8, 2011: Visa in hand.

POE and beyond

February 5, 2012: POE at JFK, no problems.

February 29, 2012: Applied for and received SSN from the local SSO.

April, 2012: Applied for and received state ID at the DMV.

(Slight delay, had to redo biometrics at the local service center.)

April, 2012: Conditional green card arrived!

Removal of conditions

2014 is right around the corner...

I had same as you i married in March 2009 and we field K3 and had interview 2 times bbbut there said not real marriage and they send our case back to uscis and we have been wait for year and half then we got diened but we field CR1 again and we are waiting for approval now ithink there is no problem to try again if u try again that will be proof enough that u love ur wife and u didnt give up but if u try for CR1 again and when ur wife sedn papers she must write letter and say that she got denied.
