should i file for waiver if a k2 visa petition expired?

i petitioned my fiancee (now my wife)3 years ago together w/ her kids.one of the kid decided to stay

to go to college there until now.since that the petition expired cuz he suppose to follow within a year.

do we need to file for waiver for him before we file for a new petition?cuz my wife is going to petition him as

an immidiate family since my wife now is a permanent resident.

I would suggest you petition the child. as a USC, it would be quicker than your wife filing as an LPR.
