Hi everyone,

My question is about the Police Clearance Certificate from New Delhi India. Here's the situation. I applied for a k1 for my fiancee in new delhi, we both are Hindus. our situation is a little awkward because my fiancee doesn't have any male figure in her house (all deceased.) It's only her elderly mother and her sisters. It was her mother's wish for us to do a religious ceremony in India rightaway and then she's free to travel with me and family to the US. So that's what we did..a religious ceremony and not an actual legally binding marriage, so no marriage certificate. But of course, people in her surrounding areas (her neighbors, etc.) assumed that ours was an actual wedding. So when she applied for the police clearance certificate, the police inquired and the neighbors notified the officer that she is married. Now the officer is stating that he will not issue a police clearance certificate because it's for a fiancee visa but she's married. We're not married though. My questions are as follows:

- I thought Police Inquiry is about a person's criminal background and not about their marital status, am I wrong in thinking that?

-How can I prove to the officer that ours was a religious ceremony and not a legally binding marriage, so he would be convinced?

-Do the officers just go on the words of the neighbors,,, how do they know whether the neighbors are telling the truth or lying?

-Has anyone had this experience and what did you do to solve this problem?

-THis is a very urgent request...

I am not an expert on this field.

But I've seen some VJ members post regarding this topic.

Short version: some of the consulates may regard your religious ceremony enough to say it was a marriage. Just a few days ago, someone posted being denied their visa because a gift was offered to the parents of the female. And the CO believed this to be a dowry, although it was not. It really will depend on the culture and the specific country.

Hopefully someone who is familiar with that office will post an answer for you.

Hmm, you may have stepped into a quagmire.

I wonder what distinction, if any, our government types make between "legally married" and married in a "religious ceremony". They may consider you married, regardless. And that would mean a K3, not a K1.

Hopefully someone else that has experienced a similar problem will reply.
