There are very few questions I can think of that haven't been asked here a million times (use the search functions), documented in a Guide or FAQ (use the blue tabs at the top of the page), highlighted at uscis.gov (visit it) or will be asked in the short time you stop by here (so scan the page of the forum you're using).

Sorry to sound like some crabby old grandpa but I had none of this to follow and I still managed to get through it with less than 10 question posts to my name (yeah, I know, give me a gold star).

Hahaha.. Thanx for the some what good response.. Im just postong and looking at different sites and a friend gave me this.. And yes i couldnt find the first post, but now i get a hang of this link.. U all should know how it is.. Just frustration and looking for different viewpoints.. What do i have to lose? Some angry responses, some ive heard, and some new ones... Just tryn to see what others have done.. Thanx for the responses though..

If you are sincere about your girlfriends US immigration status, you give ALL the relevant information, not what you think will 'help' her case.

PS: what you have to lose is a bunch of money, a bunch of time and potentially the ability for your girlfriend to ever live in the US. Stakes high enough for you yet?

I was wondering if i should go about using a K-1 for my girlfriend but she is still living in the U.S... Would she have to leave or could i still go about with a K-1 while she is still here

Did she enter the US legally?

If she is here and entered with inspection and you are a US citizen you can marry and then file a Petition for Alien relative and AOS. No visa would be necessary.

Yes, if she entered into the USA legally you can marry her and adjust her status in USA, as didromous mermaid said.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
