Hello,

we got approved and had already the interview appointment at the embassy,but we decided to cancel the k 1 visa because we notice we are not really ready for marriage.

It's sad because we decided it after everything was almost finish to get the k1 visa. Never then less it happened.

So my question is do you think it will be a problem to apply for the J1 visa after cancel the K 1 visa?

Because I (live in germany)found a job for 1 year and to do it I need a J 1 visa. We still want to stay together,but not getting marry soon.

I'm just scare that they say no at the embassy,because We just cancel the k1 visa.

What you guys think?????

Canceling your K-1 will have no ill effect on you being approved for a J-1 visa as long as you meet the criteria for approval.

You need to contact Department of State and ask for the K-1 to be cancelled, just to make sure the entry is placed into your immigration file. (Your USC petitioner should also do the same).

One note of caution: You stated that you and your ex-fiance still want to be together. That is great, but DO NOT marry him when you are here on a J-1 and attempt to adjust status. USCIS will know you were petitioned for and if you attempt to marry and adjust status on a J-1 they will view it as a material misrepresentation and you'll potentially be banned for life.

Are you sure you want to abandon your K-1? Maybe it would be better to use it, see how things go with your fiance and if things are good - marry? If not good, you can always return to Germany and apply for J-1... Just a thought.
