Hi my VJ family,

I just have a question regarding the I-129F petition. My fiance has found a new job and been working now for over 2 months. We are still waiting for our NOA2 and its over 4 months now as we are July filer. My question is, Do we need to call USCIS to update his new job or send another G325A? A friend of mine told me that it is not necessary as long as my fiance meet the poverty level, But I still want to hear more advice from everyone here. Please help me.

No because he will fill out new forms for you for you to take to the interview. These forms are what they look at when he has to prove he can support you. There is no need to update the 325 or anything like that.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

No, you can't update a 129-F. You have your NOA1. Thats good. There is no such thing as updating a NOA1/129-F . With NO RFE's your should get your NOA2 soon. His new job will be a feature for the Interveiw. SAVE THEM CHECK STUBS. Congrats on the new job.

REMEMBER, no where did it ask for Income on your 129-F or 325-A. The Income requirements will be on the 134 at your Interview. Good Luck

His new job's pay stub will be your supporting document for Affidavit of support. That's one of the papers that you are going to bring on your interview.

Yes Teapot. But if the OP is asking this simple question. Maybe we can help futhur.

Tell me if I am missing something for a new member what other information of the job/support requirements...

1# Letter from Employer stating on Company Letterhead: Full/part-time.... Salary..... Rate of pay/overtime. Date of start.... Is the job year-round or temporary. Dated, Signed in ink by the Employer. Contact information should be in the Letterhead of the Company/Employer.

Just thought the OP may ask later. ADD if I missed anything...

Thanks guys for the advice. And Also he has not working early this year from January to August, started his new job September this year. Would it be a problem for the income tax return during the interview? Hopefully I'll be having my interview next year so I am going to show the 2011 tax return. Is there a minimum requirement for the last year's tax return?

Dear, the best answers come from complete information to your best of knowledge. Yes, the economy is hard.

What would his last year (2010) tax return show? Gross Earnings. What would if asked 2008/2009 Show on tax returns ?

What is estimated 2011 Income when He Files this year?

REMEMBER, Be honest. Your interview is not today but later giving you time. Can you provide us this information? Do the best you can and others will add to help you as much as we can.

His income tax return for the past 3 years is very low and that makes us worry if the CO will be asking for it. For this year 2011 he hasn't filed any income tax yet but according to him he will for early next year. His income for his new job now is more than enough to support me according to him. I hope the CO will only be looking for this year income tax return during my interview next year.

Well, no has Filed 2011 tax returns because the year is not over. Hopefully he made at least $18,500.00. But his Currant Income at the time of your interview is most important. Your going to be showing 2011 tax returns .. and currant income for 2012. Some Consulates on only ask for last years Income Tax returns and Currant Income. Some Consulates ask for the last 3 years but some just Last years. The focus is Currant Income and a GOOD Employer Letter. Are you a family of 2 or are there other dependants involved.

Please update your VJ page and Country for the interview.

He has 1 dependent (living with the mom). what are the possible current income evidence I could show for the interview? Does it include pay stubs? bank savings?

He has 1 dependent

(living with the mom). what are the possible current income evidence I could show for the interview? Does it include pay stubs? bank savings?

Thanks for updating your Country. Philippines.

We already discused Income/Paystubs.. Bank savings is good. Bank savings is countable as an Asset.

When you say he has one dependant and living with the mother I THINK your petition is based solely upon you and Fiance. Meanning: The $18,500.00 Annual Income requirement. If he added a dependant it would be more money to meet the requirements. I don't think that applies since not in his Primary Care.

If his Currant Income is sufficient I would evade using a Bank statement unless there is alot of money in that Account.

So, others can add. But, tell me this. What is his wage per hour or salary. USCIS uses a ratio for ANTICIPATED INCOME. Meaning: 2012 when you Interview. (full/part-time)

http://www.gotcredit.com/incomecalculator.php

Hope this helps. I hope someone close to your situation can add. I have no dependants.

Do we need to call USCIS to update his new job or send another G325A? A friend of mine told me that it is not necessary as long as my fiance meet the poverty level, But I still want to hear more advice from everyone here. Please help me.

I have to agree with the friend who advised you. If you have seen what a packet from USEM looks like, it didn't say there "updated G325A".

Mortgage

Business (sidelines)

Car title

Insurance papers

Bank accounts

Bond if applicable

Now I do not know it's computed altogether, I didn't bother to research because my fiance's annual income is more than enough so that's what you should research.

The $18,500.00 Annual Income requirement. If he added a dependant it would be more money to meet the requirements. I don't think that applies since not in his Primary Care.

His kid may not be in his primary care but he is surely paying for child support. Also if you are coming with a kid on your own. Annual income be divided to you, him, his kid and your kid/s if you have any.

I disagree Teapot with the last previous posts. If the Petitioner is not delequent on childsupport enforceable by law and no order stating legal garnishments and/or sanctions against Income I see no bearing. I see one child involved that of the USC. The information will be in the USC Divorce Decree and Documents which we don't know. The OP is more concerned about Income Requirements.
