I'm really worried with my K1 visa application.

I have a pending 1-140 employment-base immigrant visa apication since 2006 with a priority date of August 2006.

I met my fiance only last June of 2009 and has petitioned me for a K1 visa June of this year.

Is there anyone who can shed light regarding this issue...

Will my K1 visa application be denied because of my pending 1-140 immigrant visa application which was filed 2006?

Please... I really need your opinions and insiights on this matter.

My suggestion is to withdraw the employment based application and be done with it.

My another problem is that, the agency that's been processing my i-140 application has stopped communicating with us for more than 3 years now since there was a great retrogression in terms of providing visas for this type and the current priority date is december 22,2005. I have been contacting them and still waiting for any replies till now.

You should have the pertinent information regarding the employment based application. Use that and write/contact the USEM yourself

and withdraw the application. If you're not able to, I don't think it will be a problem. Chances are, they will ask about it when it comes time

for your interview. Just tell them to cancel it since you will be going to the US via K-1 visa.

I surely do hope it wouldn't caused that much of a problem especially we are still awaiting for our NOA 2 until now. And yes, I'm sure they will ask me about it since I already have my Manila case # for my I-140 application. I know it will appear in their system.

Send a simple letter to withdraw the the I-140.

Ok... But i read somewhere that you can only withdraw what you have filed. But I didn't file my I-140 so I can't withdraw the application, only my employer in the states could.

Then request from the employer to withdraw/cancel the petition since you do not intend to honor it anymore.
