Hi!

Just want to ask if the Affidavit of Support (Form I-134) has to be notarized for the USEM Manila

interview?

Also, should the divorce decree be a certified true copy as well?

Thanks!

no need to be notarized...

copy would do....

Copy of what ? A certified decree? Maybe you will have to present the original at the interview. I just ordered two certified copies and sent one with my 129f so I am ready.

They definately want to make sure everyone is single so this will be an important document.

If it doesn't have the judges signature on it and a seal, I doubt they will accept it in the end. What you need is an exemplified copy. Search on the forums because other people have had to go back and get this and there have been other questions about it.

in US Embassy, Manila they accept copy only... and if u submitted a copy of ur divorce decree during the filing of 129f in USCIS sometimes they dont ask for a copy during the interview... and they accept also even a scan copy of affidavit of support too...

as far as my interview last week is concerned. they gave a checklist of the original documents the embassy needs. and it was stated there to provide the originals : live birth (NSO), ITR, W2, I-134, Annulment papers, and divorce paper. They kept those originals but just looked at the divorce papers and hand it back to me. I even asked them if they need a scanned copy, but the filipino interviewing me answered me back saying he need the original :D

Ok... Will just ask my fiance to get a certified true copy of his divorce decree and send it to me for the interview. He just submitted a copy of the decree but as I checked it, there's a judge's signature on it. Hopefully this won't cause an RFE for our NOA2. Thanks!

DIVORCE DECREE: Maybe if you sent cert copy on the I-129F application, a regular copy on the interview is ok. But it's just a regular photocopy on the application, they will ask for the cert true copy or original. Do I make sense? This has been a long confusing and everyone's got different answer.

Happy New Year!

USCIS always accepts copies of any document for case approval. Even the instructions state that copies are fine.

Consular interview is different. Most times you will be asked to produce originals of "important" documents, such as birth certs; police reports; divorce decrees. This is done because people have been known to forge these documents, so the consulate may wish to see the original. One should plan on having originals on hand for any consulate.

The subject of divorce decrees is confusing because no one can ever have the "original". The "original" with the judge's signature is always on file with the Clerk's office in whatever county/parish the divorce occurred. However, the clerk's office can always provide you with a "certified copy" of a decree. "Certified" in the legal world means certified by the court to be a true and accurate copy of the original. Certification is accomplished by the Clerk/Registrar placing their seal or signature on the document, thereby authenticating the document. DOS will always accept a certified copy.
