HELLO EVERYONE...

I’m back after years of being away from this VJ, work made me very busy both the real job and the job here at home.

I’m back because we are in the process of petitioning my son from the Phils. We are in the I-864 stage already and this form is so confusing to fill up.

My husband being the petitioner is self-employed and manages a real estate business. But at the same time we have a JOINT INDIVIDUAL TAX RETURN being husband and wife.

Here is the question:

23. MY CURRENT INDIVIDUAL ANNUAL INCOME IS: ___________??????

What figure should be entered here?

2009 is one of the toughest years for my husband. IF THE GROSS INCOME is to be entered here, there is no problem because it is way above the poverty level.

BUT if the net income is to be entered here, here comes the problem, it is way below the poverty level.

NEED YOUR INPUT MY VJ FRIENDS, desperately need your help.

Hello again,

Just a clarification and an addition to the post I just made.

I was talking about 2009 because we filed extension for the tax year 2010. Although our CPA is in the process of preparing it for us. I am just hoping that he will get it done next week. In this case, we need to wait till it is filed and ready to go together with the I-864.

And got an info from NVC with regards to question #23. The entry here as the lady said, should be an estimate of the current year's income which is 2011.

The lady was helpful and answered my questions. Not the one I anticipated.

Years ago while working for my green card renewal, USCIS people are not very helpful and friendly.

NVC people are OK! Also you get real people if you call the number 603 334 0700. You just need to be ready with the NVC case number and the petitioner's and beneficiary's info.

Right. Just make sure it appears to be inline with the total income you reported for the last three years. If you report more than that, you may have to show evidence to support your estimated income for 2011.
