Hello,

We are trying to correctly :unsure: (hopefully) fill out the I-129F form and stumbled upon two questions.

1. Part A, Q.10 "My citizenship was acquired through":

- Birth in the U.S. - we answered "YES", since the petitioner is the US citizen

- Naturalization

then it goes to ask "Give number of certificate, date and place it was issued" - since the petitioner is USC, should we put USC Birth Certificate number, date and place of issue in that slot or is this in reference to and a requirement for "Naturalization certificate" information only, i.e. should we indicate "not applicable" in that section since petitioner is US citizen by birth?

2. Part B, Q.12 "If your fiance(e) is currently in the US, complete the following:

He or She last arrived as a: (visitor, student, etc.)

Arrival/Departure Record (I-94) Number

Date of Arrival

Date authorized stay expired, or will expire as shown on I-94 or I-95

I(the fiancee) am currently in the US under visitor visa (B-2) but I will be leaving in about 3 days to go back to my home country. Should we still indicate this information into the I-129F?

Hello, regarding the first question, yes, the certificate number and other detailed information asked for is in direct response to a person's citizenship acquired through naturalization. If the person is a USC there is no further information needed in that section.

as far as the 2nd question goes, if you are still in the country and arrived as a B-2 visitor then you must provide all of the information asked for....put that you arrived as a B-2 visitor, provide your I-94 number, enter your date of arrival and the day of expiration for your current stay per your I-94. It will not prejudice your case and anyway, you must be truthful and disclose everything asked. Hope this helps, if I can be of any further assistance, feel free to message me:) Tracy
