Why would they change my status after my letter?? any opinions?? Did anybody went through that??

when they request for more evidence, it was changed into reqesting more evidence. they asked me ref for more abuse evidence

this is lucy miss ,thanks for everybody here share their stories, it is really helpful and encouraging . anybody here went through divorce,please help me , my divorce attorney will take me and my ex to court,we have to pay for the court fee and divorce fee,my ex is agreed to divorce me, I am just very confused why we need to go to court, my ex want to sign the paper in my attorney office but she doesn't want to ,she wants to take us to the court,she said it was a 102 divorce we have to go to court,anybody heard about that before, please help me ,i will appercaited very much

Hey lucy, thanks for your response but I never recieved a RFE in the first place. I just sent them a letter requesting news on my case and a extension of prima facie... that's it why I'm wondering about the change of status...

About your divorce I dont know what to tell you... Maybe you should contact another lawyer...

Hello everyone,

I'm new here but have been lurking around 4 a while & in the same boat as everyone.I filed I-360 in April,2011 & received RFE in May for Good Faith Marriage & Police clearance,Submitted both in July.Up til now, i haven't heard nothing.My attorney said she's waiting for an approval notice when i 1st spoke to her, then she called and said she inquired from them and that i should be expecting a biometrics appointment letter soon instead-she said it will take a week to a few weeks.Is this normal,do u get biometrics appointment before I-360 approval or is my attorney holding the letter b/c i still owe her some money?I'm tired of the wait.I never knew about vawa,i would have filed a long time ago before my divorce.I only found out after i was divorced but happy it was b4 the 2yr divorce limit.

If you applied for I485 with the I360 you can expect to receive a letter for biometrics.

I'm not sure what that email means, but you are right. The good news is that atleast someone is looking at your case now. I would say wait until this week. You might get an actual letter from the USCIS with more information and details. Hope that will give you so more clarification...

Guys something weird happened! Today uscis sent me a email updating my case to "response to request of evidence". However I never received a RFE!! I sent my letter Monday, so that is what they received... I'm so confused!!! But happy my case was finally touched... Whatever happens at least I will know soon...

Yeah, i know.Its killing me.I've been married since 03 & divorced 09 w/o no adjustment of status from hubby,it took me a lot of courage to file 4 divorce b/c @ that point,i just wanted out of the marriage.Found out about vawa in 2010,filed in 2011 right b/4 divorce hit the 2 yr mark.i didn't have much paperwork to submit initially-attorney just wanted to beat d 2yr mark deadline.Submitted a few things i could lay my hands on at the time.Got d RFE for Good faith marriage & police clearance, sent that in later.Attorney confirmed everything has been submitted but they don't always fill me in on details.Its frustrating, i have to keep asking questions 4m them once every week.I don't have no job right now,my source of livelihood is selling on ebay every once in a while.No EAD or ID card,i have a car that i can't drive,i have licenses that i can use to work but no EAD.So, i'm just here waiting...

You can keep track of your case on the USCIS website. And you can apply for I765 for your EAD while your vawa is pending. I just renew mine. It doesn't take long... Good luck!

I don't even know if they filed for the I-485 & I-360 together.I paid for both to be filed together.I also gave them a copy of the previous I-485 that i filed including all cards & documents that were involved.They assured me everything was filed but i don't know.After i got the RFE letter i followed d guideline from this website & registered on the USCIS website to check my status-the only thg that popped up after i typed in the reciept is the I-360 form.Even after they filed all the documents, they didn't even sent me any receipts so i can know if it was filed or not. When i check the USCIS website right now, its still showing RFE.So, that is of no use to me right now-u cannot call in for the I-360 to see what is wrong, so u just have to wait it out.So, all i can do right now is put pressure on the attorney who told me that i would get an EAD in 90days but that has long passed.I'm using the attorney's address for everything right now.So, since they said i should be patient that i'll get a biometrics appointment soon, i'll wait & if i don't hear anything, i'll call them again.I plan on calling them this coming friday anyway.

hey Lucymiss, i think ur divorce attorney can only represent u only in court & not both of u.All u need do is have them file the divorce and a copy/waiver will be sent to ur husband to sign & notarize in case of uncontested divorce.He doesn't have to be present in court unless he wants to & wants to contest.If he signs the waiver & agree to divorce u, them the judge will grant u a divorce with u & ur attorney in court & a certified copy should be requested & kept for future use.If u want to change ur name, u must also request it in that divorce letter unless u want to keep answering ur husband's name after the divorce.Make sure the attorney u r using is a divorce lawyer cause ur story looks like the attorney u r using have no divorce experience.Goodluck

You should definitely request the receipts numbers from your lawyer... go there in person and request, they have to inform you on everything and make sure they applied!! In regards to the I360 you have to be patient it takes a long time....

Also the EAD and the I485 have a number of their own... Is not the same as the I360, you should add them to your portfolio and activate the email and text alert, that way you are always updated...

Yeah, inpeace, i paid for EAD,I-485 & the I-360 together.Since i sent in the RFE,my case status have not been updated.Its still showing on "so so date, we sent u RFE..."My attorney has told me that they have heard from them & that i should be expecting a biometrics appointment letter soon.I'll call them again this coming weekend to ask how long i have to wait cause i'm really tired of waiting.I have been accepted to 2Med schools but have to defer admission cos my head is kinda whack right now.I want to be settled & organized b4 proceeding to do anythg.

Friends, I just want to share the good news with all of you. I just received email that they ordered production of my green card. I am sooooooooooo happy. :dance: I thank God for all my blessings. Friends, my best advise to everyone, never, ever give up. Keep praying and let your story be your strength and your motivation. You will all get your approvals, so you can put this ruff patch behind and move on with your life...I am planning on doing just that. well,thank you so much for your time, May you will be approval soon, my lawyer just want to take us to the court, we have to pay the divorce fee and courtcost, i don't know what is my attorney doing? we have already had the hearing date, my ex want to sign the paper but my lawyer said we are doing a 102 divorce we have to go to court. he can't sign the paper before the court date ,

Liveurlife welcome to the vawa forum,how come you paid for your EAD ? I only paid for the i-485 though I concurrently filed 3 forms i-360,1-765 and I -485 I hope your lawyer isnt trying to make himself/herself rich.Like inpeace said ask for the EAD and I-485 receipt numbers so you can create a portfolio.Wishing you all the best and everyone that is waiting for approval on there cases.
