Hi folks,

We finally received an RFE for the I-751. We sent them a joint bank statement, joint tax return for 09, flight details for a trip we took, our joint residential lease and joint leasers insurance. Interestingly they claim that the flights do not indicate a marital relationship, and want to see more evidence of financial commitment. Unfortunately we do not have 3 of the 4 examples they suggest (joint health insurance, vehicles/loans or life insurance policies.) We are planning on sending more bank statements (4 each from 2009-11), the 2010 joint tax return, W2s from each year (which they requested.) We could also get letters from friends testifying that we have a bona fide relationship but they seem more interested in the financial evidence.

Any suggestions?

You could write a short explanation for why you do not have some of the things they specifically asked for.

If you both work, or do still have separate bank accounts as well as the joint one, you could provide proof that you both contribute to utilities, etc.

If the UKC brought over money from the UK and put it in the joint account you could show that.

I guess they seem to be looking for slightly more permanent financial commitments, which may be hard to provide if you just don't have them yet. If you are saving up for and planning to buy a house together, then maybe you could provide some proof of that? Mutual deposits into savings or investments could help.

I'd probably print off copies if you can access them of deposits of checks from both of you going into your account. Yes, more statements showing bank activity and maybe a letter from the bank when the account was opened. An explanation would be good as well for why you don't have 3 of the 4 things. If you have utilities in each other's names send those in. Pictures spanning the years, why not, it might not be what they're asking for but it would show you're often together. Copy of both your driver's license showing the same address. I know they're asking for financial things but as you are lacking throw other things in there instead that married couples have. I'd get a few affidavits as well. Couldn't hurt. I would just put as much as I could into the RFE package to make up for the lack of financial things.

We were lacking a few ourselves due to just not having the money to purchase health or life insurance.

I also got a RFE when i sent my ROC, but then got approved, thankfully. What they probably really want to see is you’re 2010 joint tax return, that's my guess. But I would to send them tax transcripts from the IRS also, just to be on the save side, and give them some additional security on those papers, because transcripts form IRS can’t be faked using turbotax. The USCIS likes tax transcripts more than your every day tax return because of that.And sense they are showing thought trust issues with your case, because of the RFE, better given them some security and send them also tax transcripts.
