filing for ROC

hi guys i am gonna file for ROC on my green card in the first week of july jointly with my wife. my question is that we did not file taxes together in 2010 she filed with her parents she is not working but we did file together in 2009.is it a big issue or thats ok i will submitt just 2009 transcript only as evidence.any advice would be highly appreciated thank you.

If you guys are married, how did she file with her parents? Did her parents claim her? Why wouldn't you file together as it is such a tax break to file together?

I think it will look pretty weird filing just 2009 in July of 2011, i hope that you have lots of other documents/utility bills in both names/addresses ect.

we filed together in 2009 but this year she is not working and her parents claimed her.that's why can we file now together like amended tax or not?

So, are you unemployed also? It just is strange that a husband and wife don't file together. Well, they could file separately, but for her to be claimed by her parents is strange.

I hope you have loads of other proof of relationship as this may be a huge red flag. However, there is nothing you can do about the tax returns now, You will just have to provide what you can as you do not have tax returns for that year.

thank you so much for ur reply i really appreciate that .i am working but she wanted to file taxes with her parents.we have utility bills and joint bank account but from january 2011 because we stayed last year in her parents home because of financial reasons we could not afford an apartment.we rented an apartment in january 2011.i hope this will help what else should i send out other than that which will help .thank you.
