N-400 JUNE 2011 FILERS

My understanding is that if the children get their residency status through a parent, then they will automatically naturalize when the parent does as long as they are under 18 years... The USC spouse is not allowed in the interview but the moral support will definitely be helpful. Also, the interviewer might see the spouse and kids and focus only on the civics and nothing else to validate the marraige (since it is based on three years)..

Does anyone know if the spouse and children are required at the Naturalization interview or oath ceremony? Does everyone interview no matter what? The only interview we have done is the one my husband had at the consulate in Sydney to actually get his fiance visa. We never had an interview for 2yr or 10yr green card.

The kids were both born here, I just wasn't sure if we were required as "proof" to the interviewer or something like that. I guess they have our SSN's and a MASSIVE file on us by this point anyway!

OK! I didn't think clearly when I replied. Their presence is not required but it is good if the IO sees you with your spouse and kids... Once you receive your 10 year GC, they have confirmed that you have not married for immigration purposes only, and seeing your family there will only reconfirm it since you are applying for naturalization.

Some IOs have requested additional paperwork to prove that the marriage is still going on and that people are indeed married for the sake of marriage.. therefore, their presence will only allow your IO to skip any questions he or she may have regarding your marriage and jump into civics and a nice "Approved" stamp on your application.

Yeah, makes sense. I guess it can't hurt to take a ride into Boston! Plus, it might be weird if it's just him going considering he is being naturalized basically based on marriage for 3yrs!

OK! I didn't think clearly when I replied. Their presence is not required but it is good if the IO sees you with your spouse and kids... I think it is, especially that you are in a different district office location. Each area will have a different # of applicants causing the process to be either faster or slower. I think the average takes around 1 month to receive the notice (although the trackers here prove otherwise)... just be a little more patient.

Also - do you recall when you got your FPs last taken? If they were within 12 months (or maybe 16 months) then sometimes USCIS skips the FPs and schedules you for an interview since they are still valid... someone else can verify the length of the FP validity.

I have not received notice for FP. Priority date is June 23rd. Is this cause for concern? I ask as I see others updated with a FP date with a similar priority date.

My husband's fingerprints were done just over a year ago and we just got out appointment letter in the mail so I'm guessing they are valid for 12mo then you have to have them re-done.

It depends how busy your local office is. Our check was cashed July 1st and our FP appt is August 9th, just got the notice today

You can register on uscis.gov and they will send you emails telling you where they are in the process. We got an email saying they had mailed a biometrics notice so I knew it would be coming soon!

WOW! LOL... just after I post about not yet receiving the FP notice.. guess what arrives in the mail? ha! The notice(s). August 8th, 1pm. I think I will try to go this week as a walk in, to speed up the process a bit.

The first page of N400 Application, Part2- A- I have been a lawful permanent resident of the United States for at least five years.

if I check the box that I have been in the U.S at least 5 years and I send the application before 5 years (4 years and 9 months) is this legal or it's a lie because they will have my signature in the last page with the date, and they can check that I have been in the U.S 4 years and 9 months and not 5 years!

many people they told me you can send before 5 years, can anyone explain please and thanks!

As long as you comply with the 90 day rule then you are ok. This is not a trick from USCIS to get you to lie and then slap you on the wrist.

they allow the 90 days because they know it takes them that long to process applications... You will have to sign the application once again infront of the IO when you pass the interview and date it... That will become your application date...
