Hello friends,

My fiancé receives SSDI + VA Retirement. What are the specific documents we´re suppose to submit attach with the form I-134, like proof of financial support?

He already sent to me the documents that shows his receipts from SDDI and VA, and bank statements too. Are these documents enough?

Yes, he makes over the 125% poverty guideline.

Through the government website i found this instruction for the form I-864:

"" What does the sponsor do when he/she was not required by law to file an income tax return during a given year?

If you did not have to file a tax return, attach a written explanation and a copy of the instructions from the IRS publication showing you were not obliged to file. For general information on income tax obligations, visit the IRS website".

So, does he need send a written explanation letter why he doesn´t file a tax return?

Beyond it, it´s requested a copy of the instructions from the IRS Publication. What´s the specific IRS publication about SSDI?

Any help will be great.

Why would he not be required to file a tax return?

Not sure if this is any help. I pulled this off of the IRS website. Maybe this is why they are requiring proof. Good luck :)

You cannot file exempt.

You are not exempt because of being retired or on social security.

You may be exempt because of having relatively little income (other than social security).

If the total of your interest income is more than $9350 if 64 or younger or $10,750 if 65 or older, then you must file and must report the interest income.

If you decide to file (for whatever reason), then you must report your interest income.

If someone else can claim you as a dependent and the total of your interest income is more than $950, then you must file and must report the interest income.

If either (a) the interest income is $950 or less, or (b) no one else can claim you and the interest income is $9350 or less if 64 or younger or $10750 or less if 65 or older, then you have the option not to file, but you do not have the option to file without reporting the interest.
