Thanks for the response. Yours is a tough situation. I am sure you've already consulted with an immigration lawyer. Whatever you decide to do, keep in mind, that the USCIS have a lot of resources at their disposal when doing their investigations. I really do not see a way around the 10 year ban when the overstay is discovered. Good luck on your journey whether it is in the USA or outside of USA.

He divorced his spouse (also not a USC) who originally came with him in 98. She was from the same country. So, he would never have qualified to adjust status based on his previous marriage.
